Hi,

I parked the car and paid for 3 hrs of parking using a paybyphone stating the location code closest to my car as seen in attached image. I came back in two hours to find the PCN stating contravention code 12. I have paid for the parking so I appealed but it was rejected as attached. The location code should be 70030 and I paid for 70038. I decided to go for formal representation and received the letter today. Please help how can I reply to them. I was thinking about apologising for a genuine mistake but looks like it will not be considered. I appreciate any advice. Thanks

We need to see the PCN, your challenge, their rejection and the first page at least of the NTO. Hide only name and address.

I can see that the two locations are not right by each other but near.

Thanks for the reply. I tried to upload all pics/docs but it didn't allow me to just showing an error. Tried again today but no luck. Could you please help? It says the upload folder is full. Please try smaller file or contact administrator.

I paid on the location code visible from my car window in opposite lane 70038 instead of going further down the road and on my lane to check that if it same code or not. Unfortunately, it was not, it was 70030.

Their rejection may open a window as it says your payment expired at 14:55 but they issued a PCN at 13:31.

This says to me that they accept payment was made at the time.

It's obviously nonsense on their part but let's see what others say.

AS you have the Notice to Owner, the discount option has gone, as has their re-offer of it in the letter dated 10th September, so you need to submit formal reps this time, (or pay up, but don't pay yet !!)  and if they don't re-offer the discount, take them to London Tribunals. Winning may be difficult, but it does seem really barmy to have different codes for each side of the street. It would be interesting to know whether the parking conditions are different for each code. Has the council lost any money ? I doubt it.

Specsavers beckons I think!

Your receipt is for Gladstone Avenue which is 70038 whereas GSV shows the sign opposite no.65 Byron is for 'location 70030'.

Had you read the sign correctly you'd have entered the correct number.

Where is Gladstone Avenue, Newham?

What is the equivalent tariff for 70030?

@  Incandescent : The parking conditions are same for both sided of the road. Same amount of money for the time so council hasn't lost anything.

@ H C Andersen:  :) Yes, Specsavers. Actually, I din't know that two sides of the same road will have different code. I just paid which is closest to my car and visible from the window so I don't need to go out and open my phone on the road. If you look at the pictures, one with the PCN on my car and the notice board shows 70038. There is another picture uploaded by the warden which shows 70030 which is on the same side of the car parked but further down the road.

Hey Anderson, you are right. GSV shows old picture. If you look at the link, it shows 70038 on top of my car parked on Byron Road opposite side of house no 66. Looks like a mistake on council's part in numbering. Gladstone Avenue is two streets after.

It has open a whole new possibility.

How to proceed from here?

Cases have been won at the tribunal over trivial pay by phone location issues and their rejection doesn't say why your acknowledged payment is no good - a lot of councils have a forgiving first time policy for trivial mistakes but this is Newham.
So I would put them to the test of saying why they've acknowledged payment, pocketed the money but upheld the PCN.

OP, are you saying that currently one half of this section Byron is 330 and the other is 338?

I am not sure. What would be the situation.

Initially, I thought that I parked on the other side of the road so I got PCN.
Then, realised if it is a Byron Road (70030) having a location code of Gladstone Avenue(70038) displaying on the Byron Road sign board.
Old GSV images shows everywhere on Byron Road the code is 70030. but now, as my pic shows, it has 70038 code (Gladstone Avenue) on Byron Road.
I just paid on the code on the road I parked, I have no idea what it should be.
