Agree - the original pic posted at 09.50 on 10/10 is not clear, but this has been put into a montage, and it may well be that the original photo is clear(er).  The second photo posted at 09.30 on 11/10 is taken from a slightly different angle, but clearly shows an 8 not a 0.  The council's failure to consider the original reps may be additional fodder for the second go?

Yes you're right - I hadn't seen the other pic link.

But as I said there's no mention by Newham of codes but acknowledgement of payment.

A sign in another bay doesn't apply to the bay one is in but I do accept that in this zonal signing a wrong sign holds weight (in Islington they can and do put different codes in neighbouring bays).

If this is indeed wrong I can see how it happened - they put in an EV bay and put two new signs on the pole.

Surely the council need to explain why a sign for Gladstone Avenue has been placed in Byron Road.

The NTO is dated 8 Oct so there's about 3 weeks to make reps.

I will draft something but not for a few days.

I go on regular bike rides and could go have a look if I go east as it would add weight if the sign opposite is wrong.

The OPs photo of the sign with the incorrect code 70038 on lamppost 9 shows the front doors of 66 and 68 Byron Avenue. The doors and lamppost agree with the GSV for Byron Avenue, albeit the sign itself is different. GSV shows the door behind lamppost 9 on Gladstone Avenue is different from the OP's photo.

So I for one am happy that there's no mistake, the OP's photo shows the code on the sign is 70038 which is what he paid for, however the sign is on the other side of the road to where he parked.

I cycled to East Ham and yes that sign was obviously wrong as they've now stuck a badly drawn 0 on it. But the last pic show the bay you were in was correct. Reps need careful wording but as I said they conceded payment for parking with an end time. The roads here though do have the same zonal number so if Newham play hardball I think an adjudicator would side with you.

Hello All,
The deaodline is approaching to submit rep. Is below rep any good?


I deny liability for this PCN on the following grounds:

1. The parking was paid. The council has acknowledged the receipt during the last appeal stating the parking charge was observed at 13.45pm. The parking was paid from 12.55 to 14.55pm. See attached payment receipt, and parking appeal rejection.


2. Thanks I parked on the road outside No 67, and on the opposite side of the road outside No 66 there is a sign which gives the payment location as 70038 (see attached photos which show my car in place on Bryon road with the PCN in place and the sign outside No 66 clearly visible and showing 70038). I made payment as soon as I arrived whilst sitting in my car, using the location code easily visible from the driver's window of my car.  Since this was clearly visible I had no need to search for other signs on the road. 

In light of the payment being made in good faith, it follows the PCN must therefore be cancelled.

I've taken out the bit about sitting in car and just said it was the nearest sign and you are aware the streets there have a certain location code. You need to upload the two sign pics.

You could just go with point 1 but I think the evidence of their faulty sign is worth sending.
See if others have views but don't miss the deadline.

1. Your rejection of my informal challenge does not say why you rejected it but accepts that I had paid for parking at the time the PCN was issued. I paid for parking from 12.55 to 14.55pm. See attached payment receipt.

2. I assume the PCN was issued because of a mistake with the PayByPhone location code for Byron Avenue. I am aware that you allocate a specific location code for roads in the area and the nearest one to me (by 66 Byron Avenue) said 70038, which given the zonal nature of your system I was entitled to rely on.

I enclose a picture of the sign I took at the time showing 70038 in Byron Avenue. I have since been back to the road and seen you have stuck a hand drawn 0 on this sign (picture also enclosed). So the mistake in the location code is yours not mine.

In light of the payment being made to park, at the location indicated on your own sign, I look forward to your early cancellation of this PCN.
