Author Topic: Received a Parking Charge Notice from APCOA, confused about what to do  (Read 731 times)

I have received the attached PCN from APCOA. Looking online, it seems that they are outside of the 14 days required for them to be Pofa2012 compliant, however I have both ADHD and Autism and am getting confused by the multiple sources on the MSE forums saying similar but slightly different things.

I am unsure if the parking was paid for due to the aforementioned disabilities, and can find no record of payment anywhere, however I feel like I am certain that the charge was paid by the driver before the car left the car park.

Can someone advise? [ Guests cannot view attachments ] [ Guests cannot view attachments ]

You're correct that they haven't complied with PoFA, and aren't even trying to.

A standard non-PoFA appeal will send them packing. Here's an example of one you can submit as the keeper:

Dear Sirs,
I have received your Parking Charge Notice (Ref: ________) for vehicle registration
mark ____ ___, in which you allege that the driver has incurred a parking charge. I
note from your correspondence that you are not seeking to hold me liable as the
registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The
Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act,
and it is now too late for you to do so.
There is no obligation for me to name the driver and I will not be doing so. I am
therefore unable to help you further with this matter, and look forward to your
confirmation that the charge has been cancelled. If you choose to decline this
appeal, you must issue a POPLA code.
Yours,
If appealing online, be careful there are no drop down/tick boxes that cause you to
identify who was driving, and keep a close eye on your spam folder for their
response. If they do not respond within 28 days, chase them

Thank you, that's exactly what I needed.

When you say chase them at 28 days, do you mean only if I use their online portal, or if I email them as well?

Appeal online where possible. Only chase if they don't respond
