Letter of Claim N1SDT Gladstones

Hello everyone,

I've received a letter of claim from Gladstones which threatens a CCJ as the next step. I've found this forum very recently and there seems to be lots of really helpful people here that are able to help in these situations. I've been reading various posts and followed the guidance I found here to complete the acknowledgment of service which I submitted today 01/02/26. It appears from the reading I have found here that these claim letter are often non-compliant / deficient. I ave tried to attached my LoC which shows the PoC but I cannot seem to attach anything so apologies in advance if I have posted in the wrong area.

Any help or guidance on this matter would be really appreciated.

Read this and it includes links on how to post images.

Gladstones, or anyone, can’t “threaten” a CCJ. Only the courts can pass a judgement, and even if they do it’s not recorded if paid within 1 month.

The AoS gives you an additional 14 days to prepare and file your defence.

The situation is as below - pretty much as the example on the guide which is handy.

Upon entering the car park, the driver found a space, parked up, and went for their appointment. The appointment ran over, and when they left the car park they had exceeded the maximum parking period. On 20th Nov 24, I, the registered keeper, received a PCN through the post.

That's an actual claim, not a letter of claim...with an issue date of 14th Jan you might already be too late. Log into MCOL ASAP and see if you can still submit an acknowledgement of service, and do so if you can. If they've requested a default judgement not much you can do but pay it. If they haven't and you get the AOS in, a defence can be provided.

AoS was submitted on 1 February.
Defence deadline 16 February.

Reply #5 in https://www.ftla.uk/private-parking-tickets/help-needed-with-filling-the-court-form/ contains a previous defence, but I have not verified that it is applicable to this specific case, I have simply searched the forum, so I would not advise using it verbatim thoughtlessly.

Thankyou for everyone's help so far.

I've received an email from Gladstones with an N180 copy of the Claimants completed directions questionnaire.

The email mentions the Claimant has elected to mediate in an attempt to settle the matter, and that I now need to inform the Court if I agree.

There doesn't seem to be any deadline mentioned anywhere to inform the court or how to inform them.

What are the next steps? Looking at the jfollows link I need to complete my own N180 form now?

You supply the information on your own N180 form, which you need to submit when MCOL tells you. Mediation is mandatory.
Usual advice:

Download your own here and fill it in on your computer. You sign it by simply typing your full name in the signature box.

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.."

• F1: Whichever is your nearest county court. Use this to find it: https://www.find-court-tribunal.service.gov.uk/search-option

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and (email of solicitor) and CC in yourself. Make sure that the claim number is in the subject field of the email.

ok great thanks jfollows. haven't had any email or paperwork come through from mcol yet and I've checked the online portal and nothing their either so will wait to hear from them before sending an N180.
