Hello all,

Lovely new website by the way. I have this ticket deal with and whipped up this reply so I thought I'd post it here first. Reading the regs it seems that its out of time so the reply should be a little different no?

Dear Sir,

I write in reply to your parking charge notice ref no 2000********.

For a number of years, Warrington Hospital have had a copy of my sons disabled badge and for the avoidance of doubt, it’s attached herewith.  I have no idea whether this ticket was processed due the incompetence of Warrington Hospital or yourselves but  I can confirm that my son was with the driver at the time of parking.

I have contacted the landowner once in an attempt to have this ticket cancelled at source but to no avail.  Unbelievably, the Pals department at the hospital actually asked me to write to you instead!

At this stage in the process, I have no intention of spending any further time in an attempt to contact someone more senior there but I will do so if this ticket is not cancelled.

A simple subject access request to the hospital will prove that they’ve had a copy of the badge  for a number of years and will also prove vital in any further litigation.

As you will no doubt know, you now have two options available to you:

• Cancel the ticket forthwith
• Or send me a POPLA code

Should you choose the latter option then I will have no alternative than to find someone more senior at the hospital to deal with this and I will also contact the local press officer who I’m sure would be very interested in running a story on my sons behalf.

Please also confirm your relationship to the car - are you the registered keeper with the V5C in your possession, or is it a finance/lease car, etc. (don't tell us who was driving).

Registered keeper is a family member in my house, have copy of V5. Car is owned outright. Thanks!!

Whoever's name is on the Parking Charge Notice will be the person who needs to appeal - if you use Imgur to upload copies of both sides of the notice then, judging by the dates you have provided, we should be able to provide a suitable appeal to deal with this.

That "appeal" will get you nowhere. What exactly did PALS tell you? What exactly are the circumstances?

When you complained to PALS did you also email the CEO of the NHS Trust and ask them to get this cancelled and include a link to the NHS car parking guidance for NHS Trusts?  Have a look at the bit about "contracted out parking" and their responsibilities.

A couple of other questions... was the PCN issued as a Notice to Driver (NtD) affixed to the windscreen or as a Notice to Keeper (NtK) issued through the post? Have you already appealed to GN? Without having seen the PCN, it is not possible to know whether it is a PoFA compliant one or not. If not, there is a very simple appeal that can be used, as long as the drivers identity has not been revealed.

So, please follow the instructions as advised by @DWMB2 above and show us the PCN.

Thanks, not appealed anything to Group Nexus as driver gave me the PCN to deal with so driver not identified, no.
Also it was posted out to us, not affixed to screen. Reg Keeper will appeal it, no problem.

As expected, they are not able to hold the registered keeper liable for the charge* - on that basis, the keeper can appeal with something along the lines of the below:

Dear Sirs,

I have received your Parking Charge Notice (Ref: ________) for vehicle registration mark ____ ___, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. Please do not send correspondence asking me to name the driver. I am unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

If appealing online, be careful there are no drop down/tick boxes that cause the keeper to identify who was driving, and keep a close eye on your spam folder for their response. If they do not respond within 35 days, chase them.

*there's a link to the legislation by which companies can do this in my signature (Schedule 4 of the Protection of Freedoms Act, 2012) - as you'll see, they've made no attempt to comply with the requirements of paragraph 9, and at any rate they've sent it out too late!

Easy peasy although I prefer the shorter equivalent as follows:

As there is no keeper liability, therefore, liability cannot flow from the driver to the keeper and so, is an automatic win at POPLA.
