I received notification from DCBL for a 'fine' for £170 for an unpaid parking contravention. This is the first notification that I received. There was no prior notification for an original parking fine.

This was my car and I had used the Car Park for the Henlow Park run on a Saturday morning. Usually I paid my using the parking app but have found no payment from this day. This was done to 1 or two reasons;
1) I tried to pay but it was unsuccessful (my fault)
2) There were some signs that software was being updated - however this could have been another occasion, I can't remember but unusual for me to fail to pay.

Have no problem paying an original fine but with no chance to do so - having not been sent an original statement - I feel aggrieved having to pay a fine of £170. Any advise welcome. I will attach pictures of the notification and parking sign at the car park.

You'll be glad to know that ou can safely ignore DCBL. They are just trying to collect an alleged debt you owe Britannia Parking for an alleged breach of the terms at the car park.

DCBL are powerless to do anything. You need to check your V5C logbook address is up to date. This is the most common reason why visits don't receive the initial PCN.

As you are now too late to appeal, you are in a waiting game. You could try and contact the landowner and ask them to get the PCN cancelled. Apart from that, you are now in a waiting game to see if/when DCBL hand it over to their legal arm, DCB Legal and if they issue a Letter of Claim (LoC).

If/when you do get an LoC, let use know and we can suggest a suitable response. Not that it'll make much difference as DCB Legal are a firm of roboclaim shysters and they will eventually issue a county court claim.

Nothing to worry about though. If you respond to the claim with a robust template defence, I will place money on them eventually discontinuing. It's a well worn process. They rely on their victims being low-hanging fruit on the gullible tree and capitulating at the first sign of legal action and paying into the scam.

Follow the advice and this will eventually go away. Do not ignore a claim if/when one arrives. If your address on the V5C is not up to date, you must send a data rectification notice to the DPO of Britannia and instruct them to rectify your address and to erase your old one. They must also instruct all their agents tha they have shared your data with to do the same.

It would also be sensible to contact Britannia via a Subject Access Request to get a copy of the original notice, include two proofs of ID.
There are motorists who have been scammed and those who are yet to be scammed!

It may be worth holding off on an SAR until after a claim is filed. More often than not, the PoC will be so woefully inadequate that it is worth letting them shoot themselves in the foot and only then requesting the SAR.

What is gained by holding off on sending the SAR? Are their particulars of claim not boilerplate regardless?

Just to rule it out, given the original notice didn't turn up, double check your vehicles V5C to ensure the address is correct on there.

Because the PoC are always so poor, if the defendant has no other information, until after the claim is made, they have a genuine cause to plead the failure of the claimant to state the cause of action.

The modus operandi over on MSE is not to request an SAR until after a claim is filed.

Many of these claims are now being thrown out because of the failure to properly set out the key details in each case, including the specific contractual terms relied upon, details of the alleged breaches, and quantification of the claimed losses - in breach of Civil Procedure Rules 16.4, 16PD3 and 16PD7.

The latest update;
  • I found that my address on the V5C was incorrect and I have corrected this.
  • I have received a 'FINAL NOTICE OF DEBT RECOVERY' from DCBL recommending to their 'client' to begin legal action against me


I have corrected my V5C and updated to new address. From previous advise it recommends to send a data rectification to notice to the DPO of Britannia to notify of change of address and for them to advise 3rd parties. I'm happy to do this but part of me thinks paying £170 may just be easier.

However, I really don't want to do this as the bullying tactics are really unfair.  If I don't pay does anyone know the likelihood of it progressing further in reality and what's the worse that could happen?

You MUST send a data rectification notice to Britannia and instruct them to erase your old address and to notify all third parties that have provided with your data. If you don't, it is extremely likely that you will get a CCJ by default.

This will go all the way to a claim. However, if you defend it using the robot template defence, it will be discontinued. They are hoping you are low-hanging fruit on the gullible tree and will just be scared into paying the, now inflated, charge.

You can choose to pay the scammers £170 and be marked as a "mug" or pay nothing. If you don't believe me, go over to the MSE parking forum and read about over 360 discontinued DCB Legal claims using the template defence from there.

I have now sent a notice of data protection to Britannia DPO advising as per suggestion and requested they update their data and advise third parties. Thanks for the advice.
