Apologies for delay.
Here is the first PCN:

2
Your VRM please.

Have you looked at the council's photos?

Did you renew your permit when put on notice by the events which you describe in your first post? If so, I wonder why the second PCN was issued.

You've made reps, so it's a case of waiting. If they cancel, then that's it. But if not, the next stage is a NTO issued to the registered keeper. Is this you and are your DVLA details current?

vrm= ls67usb

I haven't made an appeal yet as I want to run it by you first

I went to have a look at the photos but your vehicle registration isn't showing in the PCN picture. Can you either confirm it or post up the photos yourself?

Hi MrChips
What do you want me to confirm? I'm unsure what you mean..

My appeal:

Dear Sir or Madam,

I write to make formal representations against the two PCNs issued to my vehicle for Code 12 (parked in a residents’ bay without clearly displaying a valid permit).

I respectfully request that both PCNs be cancelled on the grounds of procedural impropriety, improper service, duplicate enforcement, and failure to act fairly and proportionately.

**1. Failure to Properly Serve the First PCN**

At the time the first PCN is stated to have been issued, I was present at the vehicle and observed CEO 870 inspecting it. When I approached him to ask about the situation, he refused to engage in any meaningful conversation and walked away. No PCN was affixed to the vehicle and none was handed to me.

Under Regulation 9 of the Civil Enforcement of Parking Contraventions (England) General Regulations 2007, a PCN must either be fixed to the vehicle or handed to the person appearing to be in charge. Neither occurred.

If the authority asserts that the PCN was issued at that time, I require strict proof of lawful service, including CEO notes, photographs, and any body-worn camera footage.

If the PCN was not properly served, it is invalid and unenforceable.

**2. Incorrect Recorded Time of Issue**

The first PCN is recorded as having been issued at the time of my interaction with CEO 870. However, no PCN was placed on the vehicle at that time, and the officer left the location.

If records indicate that the PCN was served at that moment, this would be factually incorrect and constitutes a serious procedural defect.

**3. Two PCNs for a Continuous Contravention**

There was no ticket visible on the vehicle on the first day. The following day, two PCNs appeared.

The vehicle had not been moved. This represents a single continuous contravention. Issuing multiple PCNs for the same continuous state of affairs is excessive and contrary to established enforcement principles.

I request confirmation of the observation times for both PCNs and justification for issuing multiple penalties.

**4. Failure to Act Fairly and Proportionately**

Had I been clearly informed that a contravention was being enforced, I could have immediately moved the vehicle to my private driveway.

Instead, the officer disengaged and left without clearly advising me that a PCN was being issued. While I understand officers are not obliged to provide warnings, enforcement authorities remain under a duty to act fairly and proportionately.

This was not deliberate non-compliance. My resident permit had expired inadvertently and has since been renewed.

**5. Access Issues with Parking Account**

I have also been unable to access my online parking account. I attempted to reset my password; however, even after doing so, the system does not allow me to log in. This has caused additional difficulty in managing my permit and reviewing the PCNs.

I request that this access issue be investigated and resolved as a matter of urgency.

**6. Formal Complaint**

I have submitted a formal complaint regarding the conduct of CEO 870. I was advised by CEO 391 to include these matters within my written representations.

Given the defective service, evidential concerns, duplicate enforcement, and the technical issues accessing my account, I respectfully request that both PCNs be cancelled.

Should the authority be minded to reject these representations, please treat this letter as a formal request for:

* Full CEO notes
* All photographic evidence
* Body-worn camera footage
* Evidence of lawful service of both PCNs

I look forward to your confirmation that these PCNs have been cancelled.

1 issue is I immediately wrote an email complaining of his behaviour.
But these ceos seem to be running themselves with no accountability.

The guy who i spoke to pre email sounded just like the ceo.
Nonchalant etc.
They are all in their own group and probably look out for eachother.

When I spoke to another Ceo he first claimed the ceo i reported didnt exist then backtracked.

In short I wouldnt be surprised if they falsify images/documents etc to protect eachother.

6
The permits did expire a day before the pcns.

My arguments are
1. CEO refused to communicate the issue. Literally ignored me walked off then snuck back to give a pcn (with incorrect time)
2. The permit renewal system failed to notify me and when i tried to login couldnt

I know its my responsibility but there must be some leeway for their tech not working and their people being absolute scoundrels.

Yesterday I found a ceo checking out my car.
I asked if all was ok?
He didnt respond..
I asked again
Silence again...

I walked up now irate and said whats going on is all good.

He said something dismissive like none of yo business and started walking away.

I was now furious and cant remember much of what was said but safe to say he wouldnt tell me what he was doing with my car and just walked away with a vague threat of a ticket. (none was on my car though)

I reported this guy to the local authority as it was a disgraceful act imo.

Today i check my car and theres 2 pcns (12s parked in resident bay without proper ticket)
1 from yesterday at the argument time and 1 first thing in morning( these guys are never here first thing in the morning ususally)

Reason: expired permit

Normally i get permit expiry reminders but it didnt come through
Secondly i have a space to park in .. if the ceo spoke to me i couldve moved the car.

So I am furious and also thinking what the ceo did was fraud as hes put a fake time of yesterdays ticket.

Can i appeal on some of these grounds / hope for discretion given the improper procedures - tech and ceo based.

Cheers

Sorry: conjunctive and disjunctive may be best English.

I dont really understand but I'll add it to my reps and see how i go

Out of interest, the advance sign is improper as regards its legality. The sign is prescribed under the regs and conveys:

No left turn for vehicular traffic.

I'll bet a £ to a pinch of RHS that turning left from the main road is not prohibited.

What you cannot do is to drive past the zone signs. I agree that by signing that turning left is prohibited would have the same practical effect - although it's possible to turn into the head of the junction without fully passing the signs - but that sign does not convey a prohibition supported by an order.

A moot point or one which could perhaps be deployed if necessary, who knows?

Dear Sir/Madam,

I am writing to formally appeal the Penalty Charge Notice issued under contravention code 53J. I respectfully request its cancellation on the following grounds:

Unclear or Obstructed Signage: The signage orientation is set in a way that is practically invisible until you have already turned onto the street. This is inadequate especically when you consider the speed and througput of the Greenford road. Drivers simply are overwhelmed by other signs and stimuli to be able to safely react to that signage.

Lack of Advance Warning for Certain Directions: When I drive into Greenford Road from Costons Lane on the opposite side of Greenford Road, there is no visible advance signage alerting drivers to the restriction ahead. This makes it especially difficult for drivers unfamiliar with the area to respond appropriately.
The advanced warning sign is also positioned near to a bus stop which means any bus or van can easily obscure the sign from view.

Advanced Warning Sign is legally incorrect:
the advance sign is improper as regards its legality. The sign is prescribed under the regs and conveys:
"No left turn for vehicular traffic"
But turning left from the main road is not legally prohibited.

Recent Signage Installation: This restriction appears to be a new addition to the area. As a regular road user, I had not previously encountered this sign or restriction and had no reason to expect it.

First-Time Offence: If an offence did occur, I kindly request leniency on the grounds that this is my first such incident and was unintentional, caused by unclear visibility and unfamiliar signage.

I hope you will consider these points and exercise discretion in this case. I would appreciate the cancellation of this PCN.

How does this look HCAnderson?

So, I had a little trip up that way earlier. There is an advanced warning sign of the no right turn. The arguments I can see are that there is far more important signage for drivers to pay attention to, like the traffic lights for the pedestrian crossing just before entry into that road.

Even with a decent phone camera, it struggles to read the sign details from closer to the bus stop you see in the dash cam footage than the sign. You'd need someone smarter than me to argue that though. I will simply post my images and dashcam and watch from afar going forward.

Thankyou for this helpful footage Beedmo

AS you can see there is a turning opposite the advanced warning sign that you can turn ONTO greenford road from.
Anyone coming from there would not see this advanced sign.
Maybe your footage of the sign turn could help my case.

11
Yes I recently double checked and can confimr that sign.

I obviously didnt see it or I wouldnt have turned there.

There is also another factor. If you are coming to the turn after just turning right onto that main road you would not see that advanced turn sign.

Also if a bus is on your left it would block those signs.

Given the relatively new life of that sign maybe they would allow it as well?

I will begin to write an appeal if someone with decent legalese could help:::::

This forums traffic seems to have died off recently?
Has pepipoo migrated again?

13
And no advance warning sign(s)?

Is unclear signage enough?
I have seen an appeal that won with that argument but not sure on exact wording to use,

14
And no advance warning sign(s)?

No none that I could see!

You have to be turning before you see the sign and that is a very busy road.

15
I just took pictures of the signage from a road pov.. theres no way a car could see it unless craning their neck, which is a ridiculous requirement for all turns when driving.
So I would argue the signage is insufficient.
