Unpaid Gatwick Drop Off

Hi everyone,

I got a Parking Charge Notice (PCN) from NCP for Gatwick Airport South Terminal Drop Off dated 07.05.2024. I'm not sure why I got it because my car is registered with the Gatwick Autopay system, and I have proof of payments before and after that date.

Any advice on what to do? I'm hesitant to confirm my details with NCP without a good reason.

Don’t worry about it. As long as the driver is not identified, you can simply appeal with the following and it will be cancelled:

I am the registered keeper. NCP cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, NCP will be well aware that they cannot use the PoFA provisions because Gatwick Airport is not 'relevant land'.

If Gatwick Airport wanted to hold owners or keepers liable under Airport Byelaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because NCP is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for NCP's own profit (as opposed to a byelaws penalty that goes to the public purse) and NCP has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NTK can only hold the driver liable. NCP have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

Hi,

thanks for the reply! I was just about to copy and paste your message in. But before I do, I wanted to ask is ther any other place to launch the appeal because on the NCP site when you click appeal you have to fill in your details before you can submit the appeal.

What details do they require you to provide? You'll obviously need to provide your name and address, otherwise they won't know who is appealing. And if it's online your email so they can respond to your appeal.

Does the online form force you to answer a question about who was driving?

You should be filling your details as the appellant.

You are appealing as the known KEEPER appellant. Do not select any option that identifies you as the unknown driver.

If there’s a drop down menu or tick box that asks if you are the driver or keeper or “other”, make sure you select “keeper” or “other”. Obviously, you are the known keeper so any details you are providing are already known.

I've screen shot the parts that have to be filled out before I can send back to them.

You are the vehicles registered keeper so you need to select "keeper". For anything else simply select "other".
