Author Topic: Stansted Airport Wrong Exit - Did not use Drop off Zone  (Read 24 times)

Received this Parking Charge Notice today for use of Pick Up/Drop Off zone at Stansted Airport, even though did not use the zone for pick up or drop off. The parking was booked and paid for at the Airport's Orange Zone Car Park, but took the wrong exit from the roundabout and ended up into the Pick Up/Drop Off zone. Once you are past the roundabout into the Pick up/Drop off zone there is no way to turn back, so are forced to drive all the way to the end of the zone, to use the next roundabout to get to the Orange Zone. As you can see from the time stamps, there was no time for any pick up or drop off.

The signage at the roundabout is also confusing and not clear which exit the car should take. The first exit is the Pick Up/Drop Off zone and second for the Orange zone, but no indication which one from the signage.

Could this be a matter of simply writing to APCOA and showing the booking for the Orange zone and saying this was a mistake?  If not, what can be done? Surely they cannot expect someone to pay a fee just to drive through that stretch of inescapable road without doing any picking up or dropping off. It is not a toll road, or is it?

Any help much appreciated.

The easiest route to go down is as follows...

As Stansted Airport is subject to byelaws, it is subject to "statutory control", and as such, not relevant land for the purposes of Schedule 4 of the Protection of Freedoms Act, meaning they cannot hold the keeper liable. You could therefore appeal along the lines of the below:

Dear Sirs,

I have received your Parking Charge Notice (Ref: ______) for vehicle registration mark _______, in which you allege that the driver has incurred a parking charge. I am appealing as the registered keeper of the vehicle. There is no obligation for me to name the driver and I will not be doing so. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act").

Even if you were seeking to do so, as Stansted Airport is not "relevant land" as defined by The Act you are unable to recover the charge from me, the keeper.

I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

If appealing online, make sure there are no drop down boxes etc. that force/trick you into revealing who was driving - you are appealing as the keeper, and saying nothing about who was driving.
