Hello,

Firstly I would like to thank all of the people involved with creating this site. In an age where it seems you only have to step outside your house before you incur some form of dubious fine, sites like these are a beacon of salvation for civil libities.

So, off my soap box!

I would like some advice before I challenge this PCN,  as I think this might be a unique issue and wanted to make sure I had all my ducks in line before I appeal.

I've just received a PCN for parking I had already paid for via Ringo. Here’s the rub, there are two separate car parks, St Johns Road(East) & St Johns Road(West), separated by St Johns Road.  We parked in East. I pulled up the Ringo App,  and as it was raining I simply clicked the one that the App suggested I was closest to. Which turned out incorrect as it chose West. I paid for 2 hrs and returned just after an hour.

So although I paid for parking, it was the car park next to the one I had paid for, which is owned by Britannia Parking Group. While East is owned by Smart Parking.

So my question is, is it worth appealing ?

Can you please show us the back of the notice?

The good news with Smart Parking is that they never comply with the requirements of Schedule 4 of the Protection of Freedoms Act (there's a link in my signature if you'd like to understand the legislation), which is the only mechanism that allows parking companies to hold registered keepers of vehicles liable. Without complying with that, they can only hold the driver liable - and unless you tell them who that is, they have no idea!

Once we've seen the back of the notice, and assuming you're the registered keeper of the vehicle (tell us if not!), the below can be sent as an appeal, and will almost certainly lead to the charge being cancelled:

Dear Sirs,

I have received your Parking Charge Notice (Ref: ________) for vehicle registration mark ____ ___, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

If appealing online, be careful there are no drop down/tick boxes that cause you to identify who was driving, and keep a close eye on your spam folder for their response. If they do not respond within 28 days, chase them.

The template above has a 100% success rate with Smart so far.

It was addressed to her by the way.

Thanks - the appeal I suggested above will be suitable.

If the notice is addressed to your wife, then the appeal must be done in her name. You can of course do it for her with her permission, but make sure her details are used as the keeper.

For any drop down boxes in the online form, the appeal is being done as the keeper only, do not make any indication as to who was driving.

Just wanted to update this thread and let you know your letter did the trick!

They sent an email a few days ago confirming they will no longer take any further action.  ;D

Hi,

I have exactly the same problem at the same location.

I ignored the letters that Britannia parking group were sending me, but now I have received a letter for the small claims court.

Is there any advice on how I would go about tackling this please?

The mediation went ahead yesterday and zero was offered.

A person from the mediation team offered this advice -
- this will go to court, and the judge will only be looking at what the law says, not what is necessarily “fair”.  So make sure you’ve got your legal argument all stacked up.

Any advice someone I should do next please?
