It might be wise to upload them here so we've got a paper trail to refer back to, but, if they haven't sent any additional documents like they failed to with the first, then you can appeal with exactly the same wording.

(That is assuming the circumstances regarding the parent and child bay were the same on each occasion?)

Each separate PCN should be appealed separately. If they are all for the same vehicle at the same location, they should all contain the same exact appeal.

As this is a leased/hired vehicle, Premier Park will screw up by not sending a NtH that is fully compliant with the requirements of PoFA which is likely to win ar POPLA appeal stage.

BTW, are these all for the same alleged contravention?

Yes. These are all for the same thing on their pcn. One of the bays I'm 1000% sure is  a p+c bay. I'm trying to go through my emails now as the other I think is actually a click and collect bay as I remember ordering from m&s and collecting that day but I'm going back through my paperwork to check as it's dated 8th June.

The hirer point alone should be enough to resolve the matter at POPLA, but including as many valid points as possible is always sensible, so getting some photos of the bays in question would be good*. Ideally get some at similar angles to the ones taken by the operator, so you can demonstrate that they are photos of the same space as the ones the driver parked in.

*Could also be used as the basis for a complaint once the matter is resolved, to hopefully get Premier Park to instruct the warden to get their act together and stop issuing BB tickets for parent and child bays.

Hi all

I received three rejections today from PP.

Should I copy & paste over the same appeal to Popla. Also am I better off waiting for the 28days to give Premier Park less time to send over the correct documents? Or have they already messed up by not sending them with initial correspondence?

No. You don't send "the same appeal" to POPLA. There is no rush as you have up to 33 days from the date of the initial appeal rejection to file your POPLA appeal, so get it right. It is now too late for them to re-issue the NtH as they had 21 days from the date they were notified by the keeper and provided the required documents.

Your appeal to POPLA will need to highlight why you, the Hirer of the vehicle, cannot be liable for the PCN. As long as the driver has not been identified by the Hirer (have they?) then POPLA should uphold the appeal.

So, appealing to POPLA as the Hirer, you must point out that you are under no legal obligation to name the driver and you decline to do so. As the operator has failed to fully comply with the requirements of paragraphs 13 and 14 of PoFA, they cannot rely on the Act to transfer liability of the charge from the driver to the Hirer.

The operator has not shown that the person they are pursuing (you, the Hirer) was the driver. They are not allowed to presume or infer that the Hirer must also be the driver and that has already been set as a legal standard in previous case law. The burden of proof is on the operator to show who was the driver.

That will be be the basis of your POPLA appeal and, as always, you throw in the kitchen sink and include signage failures and lack of landowner authority into the mix.
