PCN Euro Parking Services Milton Keynes Jardines (JD GYM)

Good Evening Everyone,

Im making this post as I have received a PCN from Euro Parking Services at the JD Gym/Jardines in Milton Keynes.
The Trouble is, I recently moved address and basically It's all been going to my parents and my father is disabled. Effectively, I was unaware I was even getting PCN's from this private car park Operator.

I received one PCN, which I unsuccessfully appealed, I tried to contact the Landlord with no avail and I was prepared to pay £60 just to not deal with the hassle.
Later on this week, I went to my parents placed to find a letter from these thieves that apparently they had previously issued me a PCN from 2 months ago and I didn't pay, no correspondence in the post or anything!!

So now I am fuming, I have (to my awareness anyway) Two PCN from these thieves.
I refuse to pay now and want to know what my rights are as I have already unsuccessfully appealed with EPS.
They have some of the worst reviews out there and are known for being very scammy. In fact, when you try to pay their fee, it doesn't even allow you which I recorded on my phone.

I am aware that appealing with the IAS is useless. My main argument or the terms of my argument shall I say is that they claim I 'parked on their premises without entering registration on kiosk' there is no kiosk in the GYM and I have written proof from Jardines that their kiosk they use for these spots is only open until 6PM. All of these fines were issued past 6PM, So basically how can I even enter my registration if their kiosk is closed?

If anyone can offer any advice/suggestions going forward, I would greatly appreciate it. I may add, I have changed address but can't seem to find a formal way of informing them of my new address.

Please post the PCN (use an external host) and a street view link to the location.

To update your address you need to send a data rectification notice to their data protection officer (details should be on the PCN) instructing them to update your address for service and to erase any old addresses they hold for you.

If you don't want to pay, then you will have to weather the storm of debt collectors letters (which you can ignore) and actually defend a small claims court claim (for which advice will be provided and is usually discontinued as long as you defend). Come back for advice when you receive a Letter of Claim.

And calm down, referring to them as thieves isn't helping or appropriate. The fact their letters were going to an address you didn't have regular access to is on you. If it had been a NIP you'd be in a lot more trouble.

Provide the information requested above, this could well hinge around the availability to register at their kiosk but we need the facts to guide you

As above you can probably avoid paying them if you play the long game although the fact you have 3 PCNs means they may actually go all the way to court.

Was the driver identified?

It should be "the driver" parked etc.

I have sent them an email to notify them of my updated address.
The appeal I used was:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

I have contacted the landowner to Cancel the PCN.

Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.

Just to update as a bit of context about the image describing the location;
The area is poorly lit at night, particularly on a wintery/foggy day. You can barely see the signage.
While yes, at my fault I did not change my address, I regularly visit this address. I would've easily picked up on a notice.

In fact, I would've happily paid the £60 to just avoid the drama, but now they claim they sent me a PCN prior (I did not receive one) I am now being sent the standard DO NOT IGNORE this NOTICE.
I have emailed them to confirm how many PCN's were actually issued.

The trouble is, the JD GYM Sign sits at this car park and I see gym users regularly parking here. More importantly, the JD Gym does not make anyone aware of where to park. It is purely set up to rake in money.
As they have not identified the driver, I am tempted to transfer liability who is outside of the country and let them mail letters across the english channel.

I would have happily abided by parking rules if it wasn't misleading as shown in the image above.

Please let me know on thoughts and going forward.

Do NOT do this. Lying in order to avoid liability for an alleged debt is a very quick way to turn a civil dispute into a serious criminal offence.

You can challenge the matter on signage and any other relevant grounds, but you must not be dishonest.
