PCN Appeal - Eley Estate - CUP Enforcement

Hey everybody!

I've recently been trying to appeal a fine (EDIT: PCN) given by CUP Enforcement. I had found a thread which showed the exact letter and appeal reason, including the fact with their lateness the fine shouldn't go ahead. https://www.ftla.uk/private-parking-tickets/pps-pcn-eley-estate-n18-no-parking-area/

I don't have my letter on hand but the letter in the thread was exactly the same as the one in the thread (I will reattach it due to Imgur blocking the UK).




I therefore used the template given in the thread, as it was applicable to my own fine:

Dear CUP Enforcement,

I have received your Parking Charge Notice (Ref: ________) for vehicle registration mark ____ ___, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

Thanks.

I then got a reply by CUP Enforcement claiming that the fine PCN was now a non-POFA fine PCN and that I would still have to pay. I have attached the letter given by them to me:



How should I proceed? It seems a bit scummy that they're now claiming that it's a Non-POFA PCN. I have a feeling that they're trying to scare me into providing the details and haven't even bothered giving a POPLA code.

You could simply respond along these lines:

Dear Sirs,

Thank you for confirming that I am not liable for this charge, as you are not seeking to use the provisions of PoFA to recover the charges from me as the keeper.

There is no obligation for me to provide you with the driver's details, nor a Transfer of Liability, and I will not be doing so. To save us all a waste of time I urge you to cancel the charge. If you choose not to do so, please issue a POPLA code.

It’s not a fine.

I would ignore this latest letter. You definitely don’t have to pay a penny to them, whatever they say. They have the same ability to make you pay as I would have if I wrote to you.

Or write as suggested above. The effect will be the same.

Thank you to everybody for their quick help! I knew that they were trying to weasel their way with the PCN so thank you once again for the help.

They've made it a bit confusing to reply to whatever statement they have given, so I just sent an email to info@cupenforcement.com with the reply kindly given by you guys.
