Hello, need some advice regarding a letter before county court claim from ParkingEye. I have followed all the advice from MSE and am now at the stage where I need to prepare for the next steps, which is a first for me.

Circumstances:
On 02/12/2025 at 18:44 I entered the above car park and I left at 21:08.
The only method of payment as shown on the signs is via the Evology app which was not working at the time. I took a screen recording of the issue I experienced, showing that the location search function was bringing up no results.
By the time I gave up trying to pay because it wasn't working, I had been sat in my car for around 15-20 minutes.
At the time it wasn't working, I contacted Evology customer support and the following morning they told me to get in touch with ParkingEye.
I completed a webform on the ParkingEye website which is specifically for when methods of payment aren't working; I never received a response.
I tried to call the Duty Manager of the car park but had no response. I also tried to call ParkingEye to speak with someone to make alternative payment arrangements but had no luck there either.

Appeals:
I appealed the PCN using guidance from MSE, however this was denied.
I challenged this through POPLA again using guidance and templates from MSE but this was also denied. POPLA stated that they acknowledged there was an issue with the payment system, but that I should have left the car park instead of staying. In my opinion, I was always going to get a PCN because of the time it took me to try to make payment on the app.

Court claim:
I have received a letter before county court claim and again I used guidance from MSE to respond to this by emailing enforcement@parkingeye.co.uk and I received a reply back from ParkingEye that their position is the PCN will stand and they are willing to proceed with legal action.

I have screenshots and screen recordings from the parking event, all correspondence and I have done a Subject Access Request to POPLA for a copy of all the evidence that ParkingEye submitted to them.
