Notice to Keeper, I park services ltd

Good day all.
Today have just received a NtK for not having a valid pay and display ticket.
On the day, this location was visited to facilitate a hospital appointment. Not being overly familiar with the parking locations around this site, the driver plumped for this car park as the others were full. (There is 3 individual car parks side by side, it transpires that 2 are Leeds City owned and a third, between both managed by I Park.)
On parking the driver did as they have always done and placed their blue badge on display on the dashboard.
The driver went about their appointment and returned to vehicle 35-40 mins later and left.
Nothing more was thought about it.
The driver then returned to same facility at the end of the week and parked again but in one of the other car parks. Again, thinking nothing untoward.
Any assistance greatly appreciated, the driver is really stressed out but feels they shouldn’t have to pay any massively inflated charges

The NtK does not satisfy the requirements of PoFA Schedule 4 Paragraph 9(2)(e) or that of 9(2)(f) - in both instances the required statutory wording is missing.

Ok, I have no experience nor knowledge on these matters. So what in layman’s terms does that mean and how do I “get rid” of them.

You will not shake them off immediately - this is a sometimes a drawn out process but one you are very likely to win.

You could respond with the following as an appeal;


Thank you for your PCN / NtK which I received yesterday.

I write purely as the Registered Keeper.

As I understand it, the vehicle driver is not known to I Park Services Ltd?

Since there is no legal requirement to do so, I will not be providing any driver details to an unregulated parking operator.

No assumption can be drawn from me simply exercising my legal right.

Having examined the NtK, I can see that it fails to comply with PoFA 2012 Schedule 4 Paragraphs 9(2)(e) and 9(2)(f) - in each instance the legally required sections of mandatory wording are not present in the NtK - this is immediately fatal to your reliance on PoFA in order to invoke keeper liability since total compliance is required.

The options are therefore reasonably simple;

Cancel the PCN

OR

Waste further resources and provide me with the appeals information / codes etc.

The response will very likely be a rejection. They're not in the business of accepting appeals.
