Hi all,
Looking for advice on two PCNs from Nationwide Parking Control (IPC member, company no. 15844149) at Telcon Way, Enderby Wharf, SE10. Both have now been escalated to DCBL and I want to make sure I'm doing the right thing.
**The basic facts**
- PCN 1 - hire vehicle (Enterprise) - alleged contravention 04/10/2025, under 2 minutes. PCN issued 06/11/2025.
- PCN 2 - my own vehicle - alleged contravention 05/10/2025, under 1 minute. PCN issued 07/10/2025.
- Both for "No parking or Waiting at any time"
- I was moving out of Enderby Wharf on consecutive days. My resident access fob failed both days. On the 4th I stayed in the vehicle with the engine running while contacting the concierge. On the 5th I briefly stepped out for under a minute to speak to the concierge so they could open the gate manually.
- **Where I stopped is about 5 metres from the entrance to my underground car park.** It's literally the only place you can stop without blocking the road (which has double yellow lines). The area itself is covered with wheelie bins, trolleys and cinder blocks - clearly not a functional access route or parking area. NPC's own photos confirm this. So I had no realistic alternative - either stop there for under 2 minutes to deal with the gate failure, or block a public road on double yellows.
**The appeal saga**
NPC's online appeal portal failed - kept showing "maximum number of appeals reached" and "fine not found" when I'd never appealed before. Screenshots saved.
- 10/11/2025: Sent formal appeal & complaint by email to dpo@nationwideparkingcontrol.co.uk covering both PCNs
- 13/11/2025: Sent formal written appeal by Royal Mail Signed For (proof of postage retained)
- 25/11/2025: Follow-up email - no response
Then on 28/11/2025 I got NPC's "final position" from their Head of Customer Service:
- **PCN 1**: postal appeal logged 17/11. They claim portal "was operational." Reoffered £60 discount. Updated my address. IAS route available.
- **PCN 2**: refuses to recall. Says NTK posted 07/10 with certificate of postage, 28-day window expired early November, case now with DCBL and will not be recalled.
I pushed back firmly on 04/12 and 09/12 setting out grounds in detail. They've just replied saying "final position" and won't engage further.
**Grounds I raised in the appeal**
- Stops under 2 minutes - within IPC Code grace period
- Jopson v Homeguard - brief stops for residential access aren't parking
- I was 5m from my underground car park entrance, stopped in the only available space, with no realistic alternative other than blocking a road on double yellows
- **Signage point (this is the big one):** The signage NPC included as "evidence" of what was visible to me is from a completely different part of the apartment complex - not from where I actually stopped. From the actual stopping position, the only sign is tiny (around size 12 font), not properly visible, and clearly positioned in a way that's intentionally easy to miss. No driver could reasonably read or accept those terms from where I was. NPC are misrepresenting their evidence by showing signage from elsewhere on site
- Consumer Rights Act 2015 - signage not legible/transparent
- £100 disproportionate (no loss, none possible)
- Broken online appeal portal = procedural unfairness, breach of IPC Code
- For PCN 1 - hire vehicle, NPC pursuing me as hirer
- I'd moved address by the time the PCN 2 NTK was actually received - their position effectively makes appeal impossible
**DCBL letters now arriving**
- 21/11/2025: "Notice of Debt Recovery" £170
- 11/12/2025: "Final Reminder" £170 saying "you are no longer able to appeal"
Both at my new address - they've traced me.
**IPC complaints**
- First complaint (07/11/2025): concluded without action - IPC said I had to complain to operator first
- Follow-up complaint (28/11/2025): pending - IPC have asked NPC for evidence
**Where I'm at**
I've read the NEWBIES thread and a fair amount of MSE threads on NPC/Enderby Wharf - including UKPUMPMAN's case and another current user (ad11213) reporting the same situation at the same location. The general advice seems to be ignore DCBL, wait for any DCB Legal claim, and defend properly because DCB Legal tends to discontinue.
Questions:
1. Am I right to ignore DCBL and just keep all the letters? Anything I should be doing actively now?
2. For PCN 1 - should I take the IAS route even though it's heavily weighted against motorists, or just leave it and wait?
3. Anything obvious I'm missing on the defence side?
4. Anyone got recent experience of NPC/DCB Legal actually filing at this site, or do they tend to fold?
