Hi there,

I was surprised to have received this PCN. On the day that this pcn was issued, when I tried to pay at the machine, at first the machine didn't recognise my vehicle and I was unable to pay, but after a few attempts, it recognised my vehicle and asked for me to pay the £10 parking charge. I paid as usual, and the machine displayed that I paid and I can now leave.

After receiving this pcn, I checked my bank statement, and saw that payment was taken, however, only the day later.
When contacting my bank, they said they can see that payment was declined on 24/07 but was then taken on 25/07.
So it seems that there was something wrong with their machines that day. I also typed in my mobile number in order to get 5% off my next parking visit but never received the sms.
I imagine there was something off with their machines.

Additionally, I've tried to appeal this PCN since the moment I received it and I constantly get an 'error' message.

I contacted the about the appeal and error issue but they never replied.

Is their a regulation company I can report these scammers to? Such behaviour cannot be allowed to run freely.

We need to see the back of that NtK also. You may want to edit the image as anyone with nefarious intent could cause you all sorts of pain with the amount of data you’ve left exposed.

An appeal is made as the keeper only. There is a flaw in the Notice to Keeper (NtK) that renders it non-compliant with all the requirements of PoFA to be able to hold the keeper liable.

Obviously you say that the driver did make a payment on the day but their equipment must have failed. Don’t go into great detail at this point as they are going to reject the appeal anyway. The main point is to get a POPLA code.

I suggest a generic appeal along the following lines:

I am the keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

A payment was made and can be evidenced as your company accepted it.

As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. Horizon has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. Horizon have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

Issue is I can't even appeal it as I constantly get an 'error' message from them.

Change 'Horizon' to Parkmaven in the above. Also, if you say in your appeal that you'll be complaining to the landowner, then do so, don't make empty threats.

If the website won't work don't let that prevent you from appealing. You can appeal by first class post (get a free certificate of posting from the post office).
