PCN - paid at wrong machine

Hi all,

I have received a PCN from a private parking company - Smart parking. I visited Tk maxx in Bury which is on a retail park. I got out and paid for parking at - what I thought - was the nearest and correct parking machine. I went about my business and thought nothing else of it. Around 3 weeks later I received the PCN stating that I had not paid for sufficient parking time.

Upon researching this I have come to the realization that the "nearest" parking machine I had paid at was in fact a part of another - adjoining - car park and was operated by another company - Bury Council.

In my opinion, this is too easy a mistake to make as where I parked was literally in front of the parking machine I paid at.

Any help or advice as to any defense I can use with this would be greatly appreciated.

A few things to help us to help you:

  • Edit your post to not reveal who was driving, in line with the guidance here: READ THIS FIRST - Private Parking Charges Forum guide
  • I have removed your attachment, as you left too many personal details visible - please re-upload, with the PCN number and your vehicle registration obscured, as these can be mis-used to access the Smart appeals portal etc.
  • Are you the Registered Keeper of the vehicle? (i.e. you hold the V5C with your name and current address)

Nobody pays (not so) Smart Parking. I didn't see the NtK that's been removed but SP do not usually rely on PoFA to hold the keeper liable. Once you have shown your NtK, suitably reacted but showing all dates, we can confirm.

If the NtK is not PoFA compliant then it is a doddle to get cancelled. (not so) Smart Parking have no idea who the driver is unless you contacted them and told them it was you (bad move). They have sent you the NtK because you are the registered keeper. There is no obligation in law for the keeper to identify the driver.

Because (not so) Smart Parking do not rely on PoFA, liability for the PCN cannot be transferred to the keeper. AN appeal from the keeper stating that there is no liability usually gets it cancelled. If not, a POPLA appeal will put it to an end.

Just remember, no "I parked...". It should always be "The driver parked...".
