Europarks at Morisons - PCN

Hello,

I received a PCN for an overstayed at the Morisons car park.
The letter says the car stayed for 1h45min (but it does not say what was the limit).

£100 fine, £60 if payed within 14 days. The letter was issued on the 22th November.

They asked that if I was not the driver, to provide them with the drivers full name and address.

Is there anything I can say in the appeal to the likes "I'm not going to give that information"?

Have a look at the Read Me sticky, and post up the PCN. There's a good chance that it is not compliant with the regulations to transfer liability to the keeper.

It sounds like you've already appealed to ECP and they are phishing for the drivers identity. In the words of the famous Dad's Army series... "Don't tell em Pike!".

What you should have done first was try Plan A which is to get Morrisons to get the parking Charge Notice (PCN) cancelled. They are usually quite good at this and they even used to have a dedicated section in their customer service section on the website for dealing with PCNs issued at one of their car parks. I think that they may have since removed that specifically but you can still try by contacting them here. Make sure that you give them the PCN details:

However, here is a response I have just give to someone with a similar issue at another ECP run Morrison's car park:

Follow the advice and, whilst it can be protracted, you will not pay a penny of your well earned cash to these ex-clampers and you'll learn a lot of useful civil law and rights in the process.

Being the person in the "other" Morrisons Euro Car Parks thread, I thought it appropriate to put this comment here:

I do wonder how much hassle supermarket chains get from these third-party operators of their car parks.

Without knowing whether Morrisons get any money at all from the operating companies, I'm wondering what else might make it worthwhile if there's a steady stream of complaints from customers feeling they've been treated unjustly.

That said, I'm not sure how many supermarkets own the sites on which they operate. Many a company has sold its premises to raise capital, and then lease it back from the new owners.

Without having looked, it is entirely plausible Morrisons have taken this measure, given they are in financial distress presently. So if Morrisons don't own the land on which a store is located, they may have no say over who administers the store's car park.

That said, the 3rd party management of the car park at the store in Wells goes back some years, and not so long ago the "free" period was cut from 3 hours to 2.

I've done no actions at all. I only received this letter the other day.

I was looking for advise in what I could say in the claim process to try and not pay this.
There's no receipts or bank statements I can use.

I'm not versatile in this things, so I have no idea about the Plans A, B, C or D you mention...

Does anyone reading this has any advise what I can say as a reply?

As suggested the first thing you should do is get onto Morrisons and see if you can get them to intervene. Try this first - if you're getting close to the appeal deadline and have not had any luck with Morrisons then let us know.

I literally provided you with a link to a webform on Morrisons customer service website that is exclusively for anyone who has received a PCN in one of their car parks can use to explain to them the circumstances and request that they get the PCN cancelled. Here it is again and all you need to do is click on it as it is a hyperlink:

You state in your OP: "They asked that if I was not the driver, to provide them with the drivers full name and address." Have you already appealed to ECP and they've come back to you with this question or are you simply paraphrasing the wording in the Notice to Keeper (NtK)?

Of course they don't know who was driving unless you tell them. There is no legal obligation for you, the Registered Keeper (RK) to identify the driver as they are simply an unregulated private parking company. However, they will claim that they have fully complied with PoFA and if you don't tell them, then they can transfer liability from the unknown driver to you, the RK, whether you were driving or not.

These are all points for appeal. However, I again repeat what I posted on another thread about a similar case at a Morrisons car park, which you should really try and understand is the likely outcome if Morrisons themselves don't get it cancelled first:

And thank you for your patience!

I have asked Morisons (via the link you shared). Also, online says 2hrs free and the car was there for 1h45min.. let's see what they say.

The bit "They asked" was in that letter it says "if you're not the driver at the time of the PCN was issued, please provide the full name and address of the driver.."

They can all they like. The point is, there is no legal obligation on the Keeper to identify the driver. It doesn’t mean you have to.

It’s just a speculative invoice from an unregulated private parking company for an alleged breach of contract by the driver. Only of they’ve FULLY complied with ALL the requirements of PoFA, can they transfer that liability to the Keeper if they don’t know the drivers identity.
