Hi

On 20th August, we parked at Swan Street, Manchester SIP Parking between 09:02 - 16:48.

We paid £8.20 for 12 hours parking through the PaybyPhone app.

However, the car registration on the app was our old car, which we forgot to update.

I received PCN through the post on 27th for "vehicle not permitted and consideration period was exceeded".

I sent an appeal through their website on the same day, attaching proof of ticket purchase, proof of old car insurance policy confirming previous car ownership and admitting to mistakenly not update the registration on the app.

There has been no response yet.

Can anyone post any suggestions what I can do if they do not respond or reject the appeal?

Especially the bit in BOLD about not identifying the driver, then Modify (edit) your post so that it no longer does that please, unless of course you gave away whop was driving in your appeal?

You're rather jumping the gun on replies, if you entered an appeal online the reply will often be emailed and will often go to spam folders - you need to check them daily.

In addition to the above (reading the guidance will also advise on adding relevant photos) it would be useful for you to share exactly what you submitted as your appeal, and in what capacity. Hiding the identity of the driver here might be a pointless endeavour if you've told SIP who was driving.

The easy answer.. . When the appeal rejection comes through, as it inevitably will, do nothing further. Ignore all reminders and useless debt collector letters. If/when you receive a Letter of Claim or N1SDT claim form from the CNBC, come back for advice on how to deal with it.

If you change address in the next 6 years, remember to tell SIP to update their records with your new address for service and to erase your old one.

SIP are pretty useless and I don’t think I’ve seen a claim from them, certainly not in the last three years. Maybe one of the other regulars has.

To be honest, I've not seen that many charges from SIP crop up here or on PePiPoo (when it was still up), let alone court claims. I don't think they're a massive operator, although they do operate a lot of car parks in Manchester.

Another point to note is that once the keying error is brought to their attention they should offer a reduced charge of £20.

We do need to caveat that past conduct is not always a reliable indicator of future conduct. In plain terms, we can't guarantee that just because they haven't taken (m)any cases to court previously that they won't do in future.

Whilst the rip off “keying error” argument applies according to the CoP, the upcoming Private Parking (Code of Practice) Act 2019 will ban these scams and no “penalty” should apply for keying errors.

So, my advice is sit it out and come back if SIP ever try actual litigation.

Thanks for the advice so far.

I have received the appeal decision and they have reduced to £20 to cover the administration fee.

So, it’s up to you if you feel you owe SIP £20 for a typo. If you agree with them, pay it and be done with it… until next time. If you don’t agree that you owe SIP anything, do as you were advised, ignore any and all debt collector letter and come back if they ever try to take you to court.

..take you to court ..involving tedious paperwork and timescales with which you must comply, prior to which you'll be bombarded with threatening letters..

..providing you don't move such that they lose track of you, in which case you could be spared the above and only find out that £20 has become closer to £200 at which point you find your credit score has plummeted.

Can't see why there should be a next time. If your mistake was genuine then you've already learnt the lesson and updated all pay by phone apps, haven't you!

Given the PPC has had the DVLA cost, the cost of writing and the processing cost, £20 may be on the high side but is hardly a rip off (less than hire companies charge just to name the driver) - and its more than just a typo here.

I'm not sure any further debate about the merits/reasonableness of a £20 major keying error charge would be of benefit to the OP.

If they feel the peace of mind of closing the matter outweighs the annoyance of paying £20, they can pay it. If they do not, they can choose not to, wait out the various debt collector letters and see if the parking company try to litigate. It's their time and money, so their choice.

Which is why, in the Beavis decision, the paragraphs about the £85 parking charge being MORE than sufficient to cover the cost of operating the business AND make a very healthy £millions in profit. So, why has the government decided that charging anything for a simply typo will not be allowed in the upcoming CoP?

I decided to go ahead pay £20 to close the matter.

It simply is not worth the hassle or time.
