Hi Guys,
I hope this better from the last post. I Am really sorry for this.

He has paid the parking charges, but the company is saying you have not paid, as they think he has not typed in the correct information and his car is not showing on their system or his Reg details.

I told him you have a case , as you paid the parking charges and also you are saying i input the correct information, so this is like their words against his word.

Please advise, as you help will be much appreciated.

this is draft letter to send Euro car parks limited, but wanted your guys advice or opinion

Draft Defence (for adaptation)

I am the registered keeper and driver of the vehicle on the date in question.

The alleged parking contravention did not occur. I paid the parking charge in full at the time of parking, using the payment machine provided. I entered my vehicle registration details to the best of my knowledge and belief.

If there was any minor error in the entry of the registration number, this was a genuine keying error, which does not constitute a breach of contract. The British Parking Association’s Code of Practice states that parking operators must have a procedure to identify and cancel charges where payment has been made but the registration was entered incorrectly.

I therefore dispute the entirety of the claim, as payment was made in good faith. The claimant’s failure to reconcile payments with registration inputs is a system issue under their control and cannot fairly result in a penalty to the motorist.

I request that the court dismisses the claim, or alternatively, the claimant provides proof that no payment was received in relation to this vehicle at the time stated.
