Hi everyone,

I would really appreciate some advice.

I have received a £170 debt collection letter from DCBL regarding a Euro Car Parks parking charge at Crown Street, Bolton.

Unfortunately, this was the first correspondence I received because I had moved address and had not updated my V5C at the time, so the original Parking Charge Notice and reminder letters went to my previous address. I therefore missed the opportunity to appeal.

I have proof that I paid for parking through RingGo. My receipt shows I paid from 09:00 to 13:00. Euro Car Parks’ ANPR photos show my vehicle entered at around 08:45 and exited at around 13:05.

I have already contacted Euro Car Parks and provided my proof of payment. I have also contacted my MP asking for assistance.

Has anyone dealt with a similar situation where the first letter they received was from a debt collector because the earlier notices went to an old address? If so, what happened, and is there anything else I should be doing?

Use a Subject Access Request to Euro Car Parks to obtain all the personal information they hold on you, which will include the original Notice to Keeper you did not receive.
Ignore DCBL.
Come back when you get a Letter of Claim from DCB Legal (not the same company). You will receive a country court claim in due course but hopefully by then you will have obtained the missing documents which may be helpful in constructing your defence.

There are also many in which the original notice was not received or discarded/ignored.

You will also see that the majority of cases in which DCB Legal acts on behalf of the parking company, properly defended claims are usually discontinued before the court fee has to be paid.

If you paid from 09:00 to 13:00 then you paid for 4 hours, £3.00 apparently, but you parked 08:45 to 13:05 and should have paid £3.20 for 6 hours. On such trivia do these large invoices (they're not fines) get generated. A “grace period” of ten minutes is allowed when parking is paid for, but you appear to have exceeded this too.

If there's a chance ECP have the wrong address, you need to send a Data Rectification Notice to them instructing them to update your address for service and to erase any old addresses.  Not doing so risks any court claim going to your old address, and them getting a default judgement when you don't reply.

The original NTK will show whether there are any defence avenues based around their compliance with POFA - but if you have contacted them and revealed the driver's ID, maybe not....

Although ECP seem to have this WELL hidden on their website!

Exactly why ECP are under investigation by the CMA.
