Summary:
Received a CNBC claim form for not paying for a parking ticket. Have submitted AoS as per advice in other posts. Require advice on next steps and defence.

Details:
It was first time parking there as i was not local. I remember that the mashine was not operational due to screen not showing any information but have no evidence of it now it being 4 years ago. I assume i could of payed over phone but didnt. I didnt receive pcn due to incorrect address on my car (moving at the same time and not wanting to send my paperwork away it being delayed due to covid). I believe i received first letters from dcb late 2021 when address was corrected . I ignored their correspondence due to charge being 170£ and as advised on many forums.

West Dyke Road is approximately 2 miles long. There are several car parks off that road. Vague Particulars of Claim

I agree. I had to actually search for a while to event find it but its euro car parks parking lot on that road.

This forum and the old pepipoo forum would not advise to ignore these PPN`s.

No doubt this £170 includes a debt recovery cost and this would be challenged in any defence.

With a claim issue date of 29th October, you had until 17th November to file your AoS. Having submitted your AoS, you now have until 4pm on Monday 2nd December to file your defence.

As the Particulars of Claim (PoC) are woefully inadequate because they fail to comply with CPR 16.4, here is the suggested defence and draft order that will go with it:

1. The Defendant denies any liability for this claim.

2. There is a lack of precise detail in the Particulars of Claim (PoC) in respect of the factual and legal allegations made against the Defendant such that the PoC do not comply with CPR 16.4.

3. The Defendant is unable to plead properly to the PoC because:

(a) The contract referred to is not detailed or attached to the PoC in accordance with CPR PD 16(7.5);

(b) The PoC do not state the exact wording of the clause (or clauses) of the terms and conditions of the contract (or contracts) which is/are relied on. Simply stating "Registered users only" is vague and inadequate. Simply stating "No valid pay and display permit was purchased" is vague and inadequate considering that this clam is the only information received by the defendant;

(c) The PoC do not set out the reason (or reasons) why the claimant asserts the defendant has breached the contract (or contracts);

(d) The PoC do not state with sufficient particularity exactly where the breach occurred, the exact time when the breach occurred and how long it is alleged that the vehicle was parked before the parking charge was allegedly incurred;

(e) The PoC do not state exactly how the claim for statutory interest is calculated;

(f) The PoC do not state what proportion of the claim is the parking charge and what proportion is damages;

(g) The PoC states that the Claimant is suing the defendant as the driver or the keeper. The claimant obviously knows whether the defendant is being sued as the driver or the keeper and should not be permitted to plead alternative causes of action.

4. The Defendant has attached to this defence a copy of an order made at another court which the allocating judge ought to make at this stage so that the Defendant can then know and understand the case which he/she/it faces and can then respond properly to the claim.

Draft Order for the defence

You only need to edit in the defence your name, the claim number and sign the defence by typing your full name for the signature and dating it. There is nothing to edit in the draft order.

When you have done that, you attach both files in PDF format to an email to claimresponses.cnbc@justice.gov.uk and CC in yourself. Make sure you include the claim number in the subject field of the email and in the body just put "Please find attached the defence and a draft order in the matter of UK Parking Control Ltd v [your full name] Claim No.: [claim number]"

After you have emailed it, you must get an auto-response from the CNBC.

Hello,

I have received a N180 form to fill. Can you support me how to complete this correctly. Additionally DCB legal has sent me a letter asking for my details to be contacted, how do i proceed. Picture attached https://imgur.com/a/xB7Jq3g

You can give your email address to DCB Legal but I wouldn't give them the phone number.

Having received your own N180 (make sure it is not simply a copy of the claimants N180), do not use the paper form. Ignore all the other forms that came with it. You can discard those. Download your own here and fill it in on your computer. You sign it by simply typing your full name in the signature box.

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question

They are usually a quick affair in these cases. When it's your turn to speak, simply make clear that you are not prepared to offer anything as you do not believe you owe anything.

Do not get into a debate about the merits of your defence. If the mediator tries to get you to do so, tell them that the claimant has a copy of your defence already, and that you stand by the points it contains, and that you are therefore not prepared to settle.

It should be over pretty quickly then.

Hello,

I have received allocation for small claims hearing. Is this still within process expected where claimant will drop it?
I heard that these get dropped due to claimant needing to pay for the hearing? Any support is highly appreciated.

Yes, this is normal. DCB Legal will issue a Notice of Discontinuance (N279) before the date the £27 trial fee has t be paid.
