Hello community,

While working got a ticket by using the parking spaces for less then ten minutes at Randisbourne Garden in Lewisham.
I didn't knew I couldn't park there as not restrictions signs where visible at the time of the night. just doing deliveries to customers and surprisingly got the bellow letter yesterday posted.


Please kindly advise how to proceed

Their evidential photos (including on their website) span a total time of 39 seconds. The new Joint Code of Practice applies. They have not evidenced any period of time in excess of 39 seconds. This is a breach of section 2.24 which states the following:

2.24. Parking Period

the length of time that a vehicle remains on controlled land, which includes the consideration period.

NOTE: A parking charge must not be enforced where the consideration period has not
expired
.

Also, have a read of section 5 of the Single Code of Practice. The "Duration of Parking Period and the notes on clause 5.

The main point is that Annex B of the CoP shows that a minimum of 5 minutes must be allowed as a consideration period for a "permit" area.

Now, the issue is that CPM and the IAS are most likely going to reject any appeal, no matter how clearly you explain their failures. The most likely outcome is that this will end up as a court claim and you will see this either be struck out, discontinued or won, if it ever got as far as a hearing.

I'm sure others on here will explain the worst case scenario but I would give odds of 100:1 that what I predict will be the most likely outcome.

My personal advice, based on many years of dealing with these rogue companies is that you wait and see if/when they issue a Letter of Claim (LoC) and then come back and we'll advise on your next step. You can safely ignore all debt collector letters.

Eventually you may receive a claim and you will need to defend it with a provided template. Nobody pays CPM if they're here receiving advice.

As b789 has correctly advised, debt collectors can be ignored. It is a Letter of Claim you are keeping an eye out for.

It’s advised not to show both the claim number and password; if I or someone else with malicious intent wanted to we could log in and submit a nonsense defence.
