Private parking charge at drivers own property
« on: »
Hi the driver recently moved into a flat that has a private parking scheme, the driver received a parking permit when the driver moved in.
Whilst collecting things from the old address the driver left my council parking permit on the windscreen and forgot to replace it with the private parking badge. the driver didn’t receive the initial notice as they were sent to the previous address. The first letter the driver received was from a debt collection agency. There is no phone number for the parking management company and the driver doesn’t appear able to appeal. the driver can post a complaint in writing. The sign states ‘ where a parking charge has been affixed to a vehicle or given to a driver and becomes due an application may be made to the DVLA. Otherwise the keepers details may be requested immediately so a notice can be sent to the keeper’. No charge was fixed to the vehicle which is annoying as the driver could have appealed or at least paid early. The use of the word ‘otherwise’ also confuses the reader. It is worth further appeals? Many thanks

First thing to do is check the lease to see if it gives permission to park at the property. If there is no mention of a private parking scheme then you can claim that you already have permission to park without the need to enter into a separate contract with the private parking company - known as 'primacy of contract'.

Welcome to FTLA.

To help us provide the best advice, please read the following thread carefully and provide as much of the information it asks for as you are able to: READ THIS FIRST - Private Parking Charges Forum guide

As Intercity notes, the wording of your lease will be particularly important here. If you are unsure, please show us the exact wording of any clauses related to parking. It may also be useful to outline the parking set up at the property (i.e. whether it's allocated spaces, or first come first served).
