BW Legal - Gatwick

Hi there,

Ive recently got this letter through the post for allegedly not paying for entry into Gatwick airport.  This has happened previously and an appeal letter was successfully submitted.  On this occasion it would appear that no appeal was presented, but I actually do not recall a letter being sent on this occasion. 

What I would like is to detail this and therefore have this pushed back to the original fine which I can then appeal, please could I get advice on how to make this happen?

They won't do that.

If you don't have the original charge notice, you could send a Subject Access Request to get hold of a copy.

Ok so contact the debt collector and ask for this from them? What will this achieve?

No, contact the parking company with any Subject Access Request. In terms of what it will achieve, it will get you a copy of the parking charge notice you say you didn't receive - it is this that outlines the basis of their claim against you.

I would like a copy of the following personal data that you hold about me, and which I have
a right to view under the Data Protection Act 2018:

All documentation relating to the alleged contravention at Gatwick Airport South Terminal Drop Off, PCN: xxxxxxxx

If you need any further information from me, please let me know as soon as possible. I would like you to contact me by email: __________.

I would prefer if you sent me a copy of my data in electronic format.

I would like to remind you that data protection law requires you to respond to my request within one month.

Please can you confirm that you have received and read this request?

Looks OK. You may wish to send copies of documents to verify your identity, such as a utility bill and a redacted copy of your V5C.

You would be wise to read up on other threads on PePiPoo about the set-up at Gatwick, particularly any that have gone to the claim form stage. Here are a couple of threads that outline some of the key arguments:

Indeed - aside from the PoFA arguments one of the key ones is that the signage is inadequate. It doesn't get any more adequate with repeat visits, but I could see an unfriendly judge coming to the conclusion that you ought to have been aware of the charge if you have previously received parking charge notices at the same site.
