Hello everyone.

Other half recently parked in a disabled bay and recieved a pcn. She is a nurse at a GP Surgery, was driving around for 15 mins plus and couldnt find a space, eventually she was called by her work as patients were waiting.. so she parked in a disabled space, came back to try to move elsewhere at 10am to find the pcn.

Obviously she was in the wrong! and was going to write in and explain the situation to see if they would cancel it. (v doubtful!)

Anyway, does anyone know if everything is legit on the PCN? Any reasons to get it cancelled?

Any help as always appreciated. Thanks.

Hello All,

Just received a standard PCN from Dart charge from an offence dated 13th January! 3rd fine on this vehicle over the years after debit cards become inactive

They are requesting the £35 plus the £3.00 charge.

Am I correct in that there are still no regs for them to be able to charge for the £3.00 Road user charge?

Hang on a minute, looks like another ticket scam.  You can park in residents bays to unload/load.

This pasted from Westminster Council website :

Private vehicles

    single and double yellow lines 8.30am to 11am: as long as necessary
    single and double yellow lines 11am to 6.30pm: 20 minutes
    single yellow lines 6.30pm to 8.30am: unlimited
    double yellow lines 6.30pm to 08.30am: as long as necessary
    Pay to Park and resident bays during controlled hours: 20 minutes
    Pay to Park and resident bays outside of controlled hours (always check signs for controlled hours): unlimited

Private vehicle owners can only stop to load and unload where the items are too bulky or heavy to be carried from the nearest available parking space

Pretty sure you can file a Statutory Declaration to state your case, which will reverse the situation back. Similar happened to me but it was a long time ago and the case only ever got to Charge Certificate stage.

I would make sure the vehicle in question is in a locked garage for now, as they can clamp it forcing you to pay up. Sure someone will be along soon who will be much more help than me.

Hi everyone.

Recieved a PCN from Dart Charge for failing to pay, rang them up and asked them what was going on as we have an autopay account.

Apparently, when they went to take money the registered debit card was declined. Informed them that there were plenty of funds in the debit card account. We told them that usually a text message is received from the bank when anyone tries to, or makes a charge to the debit card. No text was recieved, so therefore thinking it was a system error on their part.

Sent in an official representation stating that fact but got a Notice of Rejection.

Is there any merit in following this one to appeal?

Does anyone know the legality of the the PCN

I had one permanently set aside a few years back, having moved address and the court claim was delivered to the wrong address. I have also heard of set asides for people who have been out of the country, ill etc. Essentially, the law will allows set aside if the defendant can demonstate that they didnt have or couldn't have had received service of papers..

Its a very simple process, fill in the court form for set asides, pay the fee and the court in time will give a date when they will look at it. I had an informal 5 minute hearing on my one, the claimant didnt turn up/or write in to defend and it was set aside. End of.

Bear in mind though, once the Claimant is served of your application to set aside, they may well start the process from the beginning, but I guess at least it should be alot less cash to find!

I believe all LA's are at this point, so skint or almost bankrupt, (morally and financially), they will stop at nothing to extort as much as possible.
When their actual job is to serve the people, in a transparent and legal manner.

Yes, I am the Authorised person.
The PCN is addressed to my company.

I cannot find my written representation, but basically I said:

"The PCN should be cancelled as the vehicle pulled over to slowly drive into a free parking space outside a row of shops. It is quite obvious the vehicle can be seen moving in the video, against a fixed street scene. It also shows the driver in the vehicle.

As this is not the first time your organisation has attempted to blatantly defraud our company of funds, an invoice will be sent directly to your offices for our time. Additionally, your head of Parking Mr ****** and the operator of the camera vehicle will be reported to the Police for investigation of the charge of Misfeasance in Public Office, and breach of the Fraud Act"

As I have had enough of tickets without any merit whatsoever, they have been sent an invoice. Its time to make a stand. A simple County court claim can follow on that one if they fail to pay. Pay dont pay, it doesnt bother me, but If everyone did the same it would collapse their extortion racket through sheer weight of paperwork.

This PCN was received for 'stopping in a bus stop'

The vehicle never stopped but slowly drove through in order to park in a marked bay outside some shops.

Its a very grainy video filmed from a camera van which drove past at some speed. Each frame of the video appears to show the vehicle moving through the bus stop.

Representation has been made pointing out the fact that the vehicle was in fact moving as the video shows. This representation was rejected by the council so think the case needs to go to adjudication.

Any helpful defence comments gratefully received! Thank you.
