Dear All,

My dad was driving the car on the alleged day. I am not sure why he reversed back out, but I would strongly think it was because of the car in front who was unloading whatever they were unloading.

Is this a case of just paying up the reduced amount?

Dear All,

I hope you can help with the below.
The driver was visiting family in Walsall and had booked a room for his daughters in the Premier Inn, that is located by the Waterfront.

The driver was just dropping the daughters off and the length of period of time was because another member of the family had the room booked under their name so they had to be present in order to let the daughters into the room. This is the cause of the delay for nearly an hour.

As a result, the driver subsequently did not think they should buy a ticket given the fact that they will not be staying at the hotel.

What can be done here please?

I saw another post regarding a similar situation in Liverpool, should I use the letter the OP sent in for their review?

Any help will be greatly appreciated.

Do not respond to Gladstones now. You will choose the county court nearest to you. Gladstones will probably try and contact you at some stage to settle but you should only offer £0.

Thank you for your help thus far.
I have just sent the email off to CNBC as you said (1x PDF and 1x draft order).

I wanted to ask 3 questions:

1. should I respond back to Gladstones email?
2. will I get to choose a local county court to me?
3. will Gladstones try and settle out of court?

Also, should I change/keep as is/delete this part of the witness statement since I received the email today from Gladstones:

And what do you mean by the "header information":

Here is a link to the Chan, Akande transcripts and draft strikeout order exhibits which need to be saved with their own court header information and marked with the relevant reference in the WS to the exhibits with your initials (eg. XX-01, XX-02 etc.).

Question regarding the n244 - am I putting my name in the claimant section? I ask, because you put NPMs details on the defendants text field and for question 2, ticked I am the defendant. Is that correct?

Sorry I should have explained my delay - my line of work requires me to travel a fair but and I only have access to my work laptop which is restricted to work use only, in the line of work I am in. I was actually dealing with the draft suggestions you kindly provided yesterday and then I received Gladstones email. I will finish and send as you advised.

Regarding the other claim, I did not receive anything regarding that so have emailed asking for more information. I will post up once I have more information.

I will come back here if I get stuck.

Hi All,

I challenged the CTO office and replied to their email above saying how could we have reasonably replied back to the notice if the registered keeper was notified first, who then sent in the actual drivers details. The whole process by the time my wife received the notice was more than 3 1/2 months.

This was their reply:

Thank you for the below email, after reviewing this matter, due to the date of the offence, the decision has been made to discontinue with this offence therefore please accept this email as confirmation that no further action will be taken.

I would however advise that should a similar offence occur, we would not be able to intervene again.


Good result in the end!

Thank you for providing the draft N244 information etc. I have not yet sent it off as I had been away for work. I got back earlier this week.

Having said that, interestingly, I received the following from Gladstones:

Good morning,

Thank you for your email.

Please accept our apologies for the delay in response.

Our client does not intend to oppose an application to set the judgment aside providing that:

1. The judgment sum is paid in full
2. You accept liability for the judgment amount and to pay the costs of the application
3. You agree not to make any application as to costs

May we remind you that £170.00 remains outstanding on file 104294.150XXX. Failure to make payment on or before the 27th March 2025 will result in further legal proceedings.

Payment can be made to the following details:

Gladstones Solicitors Ltd
Barclays Bank

Does this mean, they still want us to pay the county court judgement amount in full and bear the costs of the application?

I believe I should still do as you said in your previous post and apply to set aside the judgment. Can I recover the costs from them? I almost feel like they know they will lose if we go to set aside hence asking not to pursue costs. But i am no expert, please do advise where we stand with their email etc.

I would love to know about claiming the application costs etc from them.

Hi all,
I hope all is well.
I had an urgent query if the community can advise:

My wife is a named driver on her brother's car. Brother is the registered keeper and lives in one part of London. Wife and I live in the outskirts of Essex.

This particular day in question, in September, my wife had gone up to Cambridge and she was caught doing 80 in a 70 dual carriageway.

The first letter came came in brothers name and he was to identify the driver. This was submitted on the 5th February by brother at the earliest opportunity. He identified my wife as the driver on that fateful day.

A new letter came under wife's name, dated 6th February. Wife and I had been away and recently returned.

Wife emailed the CTO office asking why SAC was not offered, they replied with the following:

In order for a driver awareness course to be offered, we have to receive an admission from the driver within 3 ½ months of the date of the offence.

Regrettably your online admission was received on the 5th February 2025 therefore this was 5 months after the date of the offence.

In the circumstances, you will either have to accept the fixed penalty or if you dispute the offence to request a court hearing.


My wife received her notification on the 5th February so it was already over the 3 1/2 months mark, and nowhere did it say about the 3 1/2 months rule, from what I could remember. had we known, the reply would have been given promptly. She replied back stating the same. We await their response.

It's either she accepts the 3 points and £100 fine or go to court.

This is her first time getting caught speeding, and is usually a careful driver, don't know what happened that day.

What would be the best course of action in this case? Between the both of us, this is the first time we've had such a thing happen, so not sure what to do? She relies on her car a lot and is afraid this will ofcourse push her insurance up.

I would be grateful for any advice and help on the matter. We have until 14th March t respond to accepting the fine and points or go to court.

I sent the letter by proof of postage, as suggested.
Still no reply.

Shall I move forward with the set aside from my end? They had ample time to respond, but nothing as of yet. Sorry it has taken me a few weeks, but I had been away for work with no access/limited internet.
