When was the conviction date for the other points?

When the OP mentions "dangerous zone", I think he's referring to the fact that if he ends up with 9 points, he would be in danger of totting in future. I don't think he's referring to a DD40, DD60 or DD80 endorsement. So surely it would be the offence dates that matter, not the conviction dates.

You should be offered a course, as long as you haven't done one in the last 3 years.
It will cost around £100, but there won't be any penalty points.

There is no point in giving any context, as it won't make any difference to the outcome.

The request for driver identification should be answered within 28 days. Otherwise a more serious offence is committed.

The clocks went back to GMT on 27 Oct, so if the offence was committed "well before the clocked [sic] changed" you may have already missed the deadline.

If the time on the photos clarify that they are in GMT, then, IMO, it doesn't provide you with a defence, regardless of whether the offence was committed during BST or GMT.

The Speed Awareness Course is now gone, unfortunately. That settlement is not available to the court.

The best option for your wife now would be to plead guilty and ask to be sentenced at the Fixed Penalty level, as a COFP was offered, but couldn't be accepted due to administrative reasons unrelated to the offence.

Got the NIP from my friend, although it does not say Notice of Intended Prosecution. It says Conditional Offer. Are they different.


Yes, a Notice of Intended Prosecution is different from a Conditional Offer of a Fixed Penalty.
This is why it's not a good idea to post on someone else's behalf.

The cloning of vehicles isn't that common, but when it does occur, the 2 vehicles are usually the same make, model, body type, and colour.

Far more likely is either a plate misread, or a mistake on the NIP. Request the photos.

Were you driving your car at the location and time stated on the NIP?
If you were, the chances of a clone of your car being at the same location, at the same time, are extremely remote.

Even if I receive photos of a saloon car with my registration I doubt I could identify the driver, as I assume that would be someone random.

Asking for photos to help identify the driver is just an excuse to get your hands on the photos. In your case you want them so you can identify whether it's your car, or not. Even if you were driving, it's unlikely that you would be identifiable in the photos.

No. If it turns out to be your car, fill in the S.172 request confirming you were driving, and the process will continue as normal.

Be aware that requesting photos doesn't stop the 28 day clock to reply.

Ask for any photos to help you identify the driver. If they are provided, you'll be able to confirm whether it's your car, or not.

I did just that but sent an email instead with the form attached. I have received confirmation today that they have received the form and it has been actioned.

I would also physically send the signed form.

More knowledgeable members will correct me if I'm wrong, but I don't think an emailed copy of the form would be admissible as evidence of you being the driver.
