Will I get prosecuted by council?

England local city council

I’ve messed up. Parked up in disabled bay and used an invalid badge. Potentially lost/stolen. Found the badge in a car park. Used it once got caught. Paid the PCN. But now worried local council will take it further. They have all details from car registration. I have sent the badge back to local council.

Will I get larger fine? Criminal record? Will the council even follow it up?

I know I’ve done wrong and rightly deserve to face consequences. Just worried about it and can’t sleep.

It is a criminal offence to misuse a BB with max. fine up to £1000.

From what you've posted I wouldn't think that the issuing authority would care two hoots about the matter. Furthermore, you posted:

The only details anyone has from car registration are those of the registered keeper, which tells them nothing about who used the badge. These details aren't available from your payment because anyone can pay a penalty charge. So, apart from the issuing authority* not being interested IMO they wouldn't know who to pursue anyway..unless you admitted it was you in a covering letter sent with the badge or during the PCN process.

- * are the BB issuing authority and PCN enforcement authority the same?

Not admitted anything. Just paid the fine sent the badge away no letter just to address on website I found for lost badges. Panicking thinking they are going to pursue further action using a lost/stolen badge. Not sure about sand council and issue authority. Don’t know where it was issued.

This morning received letter from council with booklet to fill in under caution asking where I got badge why did I use it standard stuff. Should I be getting some advice from solicitor panicking now thinking I’m gonna get in serious trouble. Not sure what to do moving forward.

Misused blue badge received caution letter/questionnaire from council.

Misused blue badge I found in street. Received PCN, paid PCN, now partner has received letter with questionnaire that is classed as being questioned under caution. Should I speak to solicitor? Or just own up to using badge and that I made a mistake didn't realise it was a crime. Badge has been returned to authorities.

Let's have a look at the letter and questionnaire. Redact your partner's name and address. Is your partner being asked to name the driver? Instructions are here.

Whatever happened on this case? Did you return the booklet? Has there been further movement on it since returning? Asking for a friend.
