Afternoon all,

I succesfully appealed a PCN when coming off the motorway into RRoad and it was cancelled. Stupidly I made the same  mistake but didn't realise until I was too late.I challenged this in Jan 26 as Enterprise sent the notice and had no response. I sent follow up emails a few months ago and nothing. A week ago I received the PCN which is now in my name. They have told me I need to appeal again as I wasn't the registered keeper so I couldn't appeal (rental) and now enterprise have transferred liability and I am now the keeper.

I have responded and told them I can appeal without being named the keeper and my previous challenge was successful. They already have the information so I will not resubmit as I sent this 6 months ago and the info is the same.

I don't think I am going crazy but this is a new one.

Is this a PCN for entering a road prohibited to motor vehicles?

If so then no, you can't normally submit representations against a PCN that isn't addressed to you as you have no legal involvement as a third party.

The correct course of action is for the hire firm to submit representations that they are a hire firm and then name you as the hirer. At which point, assuming all the paperwork is in order, the council can cancel the initial PCN and serve one on you instead.

How did you receive the initial PCN if it wasn't sent to you? Did the hire firm make you aware?

Please to post up copies of the documents received and sent (all sides, only redact yr name & address - leave all else in).

There's an awful lot of thems in yr opening post, and it is not clear which refer to Enterprise and which, to H&F Council.

Thanks for the reply. Yes it is for entering a road with no motor vehicles.  I had the last PCN cancelled when enterprise sent me the letter and I appealed using only that nothing was in my name.

They have now changed their mind and asked me to go to tribunal. Is there another app like imigur that I can use to upload?

The motorway signs in the picture were not there when I drove, but looks like there is no other appeal apart from tribunal

Just double checked, H&F automatically cancelled the PCN in Feb 26 after my appeal for RRoad. This new PCN is for the same road but in Jan 26. Strangely they did nothing with the first appeal but cancelled the latter PCN?

We need to see the PCN addressed to Enterprise which was forwarded by them AND any covering correspondence; your PCN; your reps and their NOR.

Leave in everything except addressee details.

From what you've said your PCN is probably timed-out, but only you showing us the notices would help us to determine this.

Possible scenario:
Enterprise receive their PCN; they send this to you along with a copy of a so-called Third Party Authorisation; you write to the council(thinking you're doing this on your behalf, but in reality simply as Enterprise's nominated Third Party); you did not receive a response(but as you weren't entitled to one, that's not surprising); and then.....

Council disregard your(Enterprise's) submission in total;
They consider your submission and reply to Enterprise.

But then Enterprise are still on the hook!

The possibilities spin off in too many directions... YOU MUST post the docs pl.

I've never seen such shameless tosh in a council letter of refusal !  Their own photos show how inadequate the signage is ! Of course it's your choice whether to take them to London Tribunals, but they really do need to be shamed in front of an adjudicator.

;D thanks incandescent. The signs are a lie they were never there when I drove down the road unless I am temporarily blind.

They've screwed themselves anyway, they cancelled a charge for the same thing for the same reasons now they've changed their mind. They may aswell close the road. If I moved there it is expected if you live near a motorway it's a road.

Then changed the rules transferring the PCN to name me when they didn't previously and changing their mind again when challenged.

And getting them to prove the signs were there when the PCN was issued there was no prior warning.

Apparently you can get prior permission from residents or buisnesses (I was dropping back to Enterprise) so will state that too.

Is it going to cost or is it tricky going to tribunal?

This is what enterprise sent,reading now I can see that they said wait for it to be transferred. But if that is the case how could I appeal the previous one with the same document?

So annoying
