PCN in a free parking

This must be the stupidest pcn I have ever received (my fault). The parking is free for an hour, you just need to input the code on the RingGo app. Unfortunately I had no 5G and the app just wasn't loading. I walked over to get the phone number and then decided to keep trying the app whilst I popped in to get my dry cleaning and I was watching the car at the same time. I was literally minutes and finally managed to park via the app whilst I was walking back to the car. From the time I parked and locked the car to the time I returned was 8 minutes. In that time somehow the CEO managed to issue me with a PCN, even though I kept checking over. He must have done it so quick I didn't even see him. I find it hard to now pay £55 in what is effectively a free parking zone.

Any suggestions?

If you are prepared to stand your ground on this, you have a good chance of winning at London Tribunals, because the PCN says you didn't pay the parking charge, but there is no parking charge for the time you were there.

So I suggest you submit representations that you made every attempt to register a free parking charge, but The Ringo app, mandated for this car park by the council, would not accept your input for many minutes, but you did finally manage to register your car. tell them that in between your time of arrival and the registration time, a CEO served a PCN. You request that the PCN be cancelled as you made every attempt to register but this took several attempts.  Don't be upset if they refuse these reps, because as far as councils are concerned, PCNs are there as their Magic Money Tree, and they know that if they refuse all informal reps, most people, (like >95%) just cough-up to get the discount. The basis of paid parking is that time is always allowed to pay for parking, and your case is the same.

What was your challenge.

What time did you start the session.

There is no observation time on the PCN.

I cant find a copy of the appeal. I have been on their site and looked at my emails but there is nothing there. By the time I managed to start the session it was 16 past.

Some adjudicators will look favourably on time to start a session and may that not paying for a free session cannot be a contravention.

Others will look at the 7 minute gap and be suspicious you only took out a session when you saw the PCN; and are happy that free sessions can be penalised by not paying according to the traffic order.

I'd say the best bet is to go back and see if you can replicate the issue with the app/signal and take screenshots.

What's your VRM(we need this to check the council's photos)and are you the registered keeper with current DVLA details(the next notice goes to the registered keeper)?
