Author Topic: PCN Help - Newham - PCN for 01a / Didn't see this warning board for restriction  (Read 642 times)

Hello

I am not someone who ride car often. So didnt see the board for restriction / warning notification. So it was parked on road and the traffic warden issued a PCN on the day. Around 9.30 AM my wife after returning from shcool dropping the children saw the yellow cover on car and notified me. I was working from home that day and I immediately stepped out and moved the car.

Are you able to get a better (readable) photo of the suspension sign if it is still up?

Sure ofcourse. Thanks both for your kind response.

It's worth noting that there are no trees (but there is a very small lean plant or a tree and this has no branches to cut and also this tree is further away from the door numbers restriction was applied) on the road.

So looking at GSV, the suspension affected the first three properties from the start of the parking bay. 240 is outside the bay by the built-out kerb. Your car is clearly parked in the suspended area, at No 236, if I'm right. The suspension sign is only a few yards from your car, yet you say you never saw the suspension notice. Yet your wife saw the PCN envelope, yet not, it seems, the suspension sign itself. Frankly, in my opinion, you are going to struggle to overturn this PCN, as you were resident in a nearby property when the sign was put up. I'm quite puzzled why either you or your wife never saw the suspension sign, or maybe you did, but ignored it.

Thanks for your response. Why would I ignore if I know I am going to get a PCN.

I am not justifying but here is my situation - I work full time, use by bike for office commute - 3 days in office / 1 or 2 days from home. I leave around 8 AM and return around home around 8 PM. I dont know when this notification was put up, same with my family.

I was reviewing the CCTV footage, may be a large vehicle was parked in front of the post and we may have missed ? May be it was on and around for months - but I never noticed it as I use my bike / walking mostly walking on the foot path either on the left or right (as I dont prefer walking across as this is kind of main road / junction where you see many vehicles pass by and turn) and then turn.

And the expectation from council and authorities that - I will put a board for restriction for a future date/close by date and you are expected to see that, remember the date -time and make arrangements to move is ridiculous. People genuinely miss seeing these. As I said, I am not someone who use the car much for commute.

And I don't believe any work took place on that day either. There are no trees in front of these houses. While I was typing, I checked to see if the yellow board on the street light pole was still around, it is gone now.

OK, fair enough, but so far I've read nothing that might form a robust appeal. The plain fact is the council photos show the suspension sign is only yards away from your car. Of course, you have the absolute right in law to take Newham all the way to London Tribunals if they reject your representations, (informal challenge, and formal against the Notice to Owner), but it would be with the full PCN penalty in play. With this is mind you have to explain why the notice was not seen.

I have looked again at the photos, and the suspension notice does not have the usual 'wings' to make it more prominent from each side, the notice itself faces the carriageway, so you could put this in as a reason.
