The full penalty is in play if you take the matter to th Adjudicators, but there are no additional costs to pay nor any prospect of a CCJ. The original legislation was carefully written way back in 1991 to exclude county courts from the process, and that has continued with later Acts.
You're in for £35 now, and that doubles at adjudication, so an extra £35, or nil to pay if you win. It's a double-or-quits gamble essentially. We try to give advice that indicates the likelihood of a win, but some ajudicators are real hanging judges, I'm afraid.
