probably already shot myself in the foot as ive already logged an appeal and theyve rejected it.

i recently had to attend a physio appointment at my local GP at 9:00am. i parked nearby on double yellow lines at about 8:45 and put my blue badge in the window with the clock set. unfortunately id put the time as 9:45am. i went in the GPs and when i came out at about 9:26am i had a yellow notice from Lincolnshire CC. i went online and appealed first asking why i had received the notice. then after reviewing the photos realised my mistake and sent a follow up appeal. they have rejected the appeal even though i sent a copy of the email showing the appointment time and that i was in pain and maybe that was the reason i made the mistake.

the thing is the whole thing seems to be run by a private company called APCOA and i wonder if i was actually dealing with the local council if they would be more compassionate.

this is there response, i reject the time set being 10am as i set it to 9:45am:

Thank you for your challenge, received in respect of the above Penalty Charge Notice. After careful
consideration of your informal challenge, I have found no grounds for the cancellation of the charge.
A Penalty Charge Notice (PCN) was issued due to your vehicle being parked in a restricted street during
prescribed hours. The Civil Enforcement Officer (CEO) observed your vehicle at 09.08 on 28/10/2025, for
a period of 5 minutes, parked across double yellow lines. A disabled badge and time clock were on
display; however, the time clock displayed a time later than when your vehicle was observed. No
permitted activity was witnessed and as such, a PCN was issued.
I have noted the comments within your challenge; however, the arrival time was set to 10am, which was
in advance of when the penalty was issued. Ultimately, it is the motorist’s responsibility to ensure that a
valid badge and time clock (set to the quarter hour period during which the vehicle arrived) are correctly
displayed when parking their vehicle. The officers use this to determine whether the vehicle has
overstayed the prescribed limited wait time. When the time is set later than when the officer observes the
vehicle it invalidates the blue badge. Therefore, the penalty was issued correctly and remains
outstanding.
I am able to re-offer the discounted amount of £35.00 if payment is received within 14 days by 12/11/2025

Post the PCN, both sides, as we don't see many from this council.

If you go on you'll be asking them to use discretion based on evidence you didn't exceed 3 hours.

With blue badge contraventions, they may have a policy to allow a first one, and they may make a more considered decisions at formal stage.

But their policy is a tad contradictory as they are less happy with a wrong clock time than no clock:

Failure to display valid Blue Badge

Failed to display
• notice to be upheld. If the valid Badge is produced the Notice may be waived but
only on one occasion per Badge owner
Expired Badge
• notice to be upheld. Discretion may be exercised if valid Badge is produced within
one month of expiry date
Badge face down
• if the valid Badge is produced the Notice may be waived but only one occasion per
Badge owner
Badge on floor
• notice to be upheld. If a valid Badge is produced the Notice may be waived but only
on one occasion per Bade owner
Clock time set incorrectly (on street only)
• notice to be upheld. Discretion to waive the charge may be exercised if arrival time
shown is less than 15 minutes from the time of observation
Clock time expired (on street only)
• notice to be upheld. Discretion to waive the charge may be exercised if time shown is
less than 15 minutes from the time of observation
Badge with no clock (on street only)
• on one occasion per Badge owner discretion will be exercised. Thereafter mitigating
circumstances will be taken into consideration

I did 2 challenges on the same day as the first one was because I couldn’t figure out why they had ticketed me. The second one, after I reviewed the photos, explained why I had probably made the mistake, due to being in pain with a pulled muscle in my back.

How do I access these representations as I did them online.

OK, fine. So if you can, just gve us the main bullet points as far as you can remember them. The council have a duty to consider your reps, so if we can compare their letter with your reps, we can see if they have committed a procedural impropriety

The initial challenge:

Asked why if I had displayed my blue badge and clock I had been given a ticket.

Second challenge same day once I’d looked at the pics more closely:

I said that I now realise I had set the wrong time, I was attending an appointment at the GP at 9am (I sent a screenshot of the GP appointment reminder email), and that maybe it was because I was in pain that I accidentally set the wrong time.

They replied saying basically don’t care. So I replied asking if they had seen the second challenge, they said they had and still don’t care.

What I find crazy is it took me inspecting the photos to figure out why they had given me the ticket. It’s not like it’s clear from the ticket the exact reason. Another thought I’ve had is if the clock in the car had updated for the clock change the day weekend before. Plus I was taking medication for my back that can cause hallucinations as a side effect. Though I forgot to mention that.

Normally one has to alter clocks manually when summertime starts and ends. At least it's like that on my cars, although they are all at least 8 years old.

Mine are now displaying the correct time just wonder if they hadn’t updated when I set the badge clock. I’m normally pretty careful with things as I have anxiety/OCD.

It's your right to have another go at formal stage, reminding them of their duty to act fairly and especially with a BB holder with certain conditions, that you were less than 3 hours and didn't misuse the BB, and their policy does indicate discretion for a number of first time mistakes with BBs.
