Dear Moderators,

I would like to ask for your help & advice.

Daughter has received PCN for 31J alleged infringement as she is Keeper, but I was driving and she was at work.  Grounds for representations do not include category to state she "was not Driver".  Should we start the process by declaring that fact?

Although the PCN says "stopped on YBJ", the vehicle was still proceeding slowly behind traffic in front.  Shall load up the details tonight.

Also, I notice the PCN does not make reference to any Legislation, and wonder if this is the norm?

Only just caught up with recent post and have only about 7 days to respond, and would appreciate any assistance.

Hello.

Grounds for representations will not include a category to state she "was not Driver" as this isn't a ground.  Identity of driver is irrelevant as it's the vehicle's owner who is responsible for the penalty charge whomever was driving.

As such, while you can assist your daughter with this matter, all correspondence with the council (and potentially thereafter with the tribunal) should be sent as if from her.

Consequently, while it may be helpful context when it comes to drafting representations, it's unlikely to be hugely relevant and it's not worth focussing on too much.

Can't offer much more assistance until we see the PCN and video - if the car genuinely did not stop moving then that ought to mean the PCN was incorrectly issued and is beatable.

Hello Mr Chips,

Apologies for the delay as I could not post the images successfully, and had to meet up with my daughter for help in forwarding the relevant photos.

On the day, I proceeded onto Gliddon Rd from Palliser Rd where it met Margravine Gdns,  entering the box slowly when I saw the vehicles ahead moving along.  I don't recall getting trapped within - which is what the LA is alleging.  I certainly was not blocking the path of any vehicles.

Also included is a photo of the junction box that is longer/wider than the road leading to that point - which I hope will help.

Hammersmith appears to have set up many box junctions in multiple spots, resulting in traffic being mostly backed up, at busy times as nobody can move for fear of getting trapped in the hatched area. 

For example, just today mine was the first vehicle in a queue of cars at a crossroad with a box junction, but could not join the traffic until after the lights had changed five times (stationary for over 30 minutes), due to the long tailbacks on the main road preventing cars from proceeding further.

From your description, it sounds like you haven't watched the video evidence yet - I'd recommend you do so (it can be accessed by inputting the PCN and vehicle registration details at the link below):

Unfortunately, in my opinion it shows a fairly clear cut contravention.  The vehicle gets stuck for several seconds at the far end of the box junction marking behind a stationary vehicle.

You still have a few days before the discount expires but I couldn't see any obvious strong points to challenge this on.
