Charge Cert Recieved - Merton Code 53J
« on: »
Hello,

I have today recieved a charge certificate from Merton Copuncil for entering a pedestrian zone. This is the first communication I have recieved from them, no other letters at all.

Date of contravention - 21/03/25
Date of PCN isued - 11/04/25
Charge Certificate Issued - 15/05/25

I can't appeal to them - what options do I have, please?

Thanks
T

Wait for the next document in the chain which will be an Order for Recovery. You can get the enforcement process reset to the PCN stage by filing a Statutory Declaration to the Traffic Enforcement Centre of Northampton County Court. Please follow the guide here. When reset the Council will serve the PCN again and you can pay or challenge and appeal.

Post back when you get anything.

You should be able to get this automatically reset: for the process now see
https://www.ftla.uk/announcements/charge-certificates-london-local-authorities-and-tfl-act-2003-london-local-autho/msg20808/#msg20808

The most important thing is not to miss deadlines.
Does Merton's website have a page for the history/status of a PCN (often lurking under PayMy PCn or ViewEvidence or somesuch)?

Any problems with the post? Is the address on the V5C and on the Charge Cert. correct in every particular?

And please have a read of the READ THIS FIRST - **BEFORE POSTING YOUR CASE!** sticky post at the top of the forum. You are explicitly asked to only redact/obscure  your name & address from documents. Please leave everything else visible especially the PCN number and the vehicle reg (VRM).

Please correct and repost the Charge Certificate.

Thanks.

John U.K/Enceladus - The history of the PCN has 3 lines as below and no issues with post. Details on V5 and charge cert not correct in every prticular, there is 1 letter speiiling mistake on the name.

Ticket history
15/05/2025 10:00:47 Charge Certificate Issued
10/04/2025 10:27:09 PCN Issued

OK.

Spelling mistake on V5 is your problem. If it's significant, then get DVLA to change it. If this has been carried through to the CC, then it strongly suggests that the council followed correct procedure in obtaining your keeper details from DVLA.

Thanks HC.

It's a minor one on the surename, in the 14 letter surename instead of an "i" there is a "t" thanks all, all else is fine.

Thanks

update - I phond theh council to advise I never recieved anything prior to CC and they have re=set this back to initial stage. (had to do this as the ticket was for my mother and she was stressing and wanted to pay the £195).

However, upon checking back onthe website it shows the below attached #confused

Thanks for all help

What does the Ticket History screen show?

'Reset', whatever this term means to them.

Their options are to consider reps made outside the 28-day period or cancel or register with the Traffic Enforcement Centre.

What do you have in writing?

catnip:

Ticket history
30/05/2025 12:35:58   Post Charge Certificate Correspondence
15/05/2025 10:00:47   Charge Certificate Issued
10/04/2025 10:27:09   PCN Issued

H C Andersen

By reset I was told it will revert to oricginal PCN so I will have option to pay £65 or appeal. (So once that shows up I was going to pay it)

Thanks.

The ticket history now show's the below

Ticket history
02/06/2025 10:26:33   PCN Issued
30/05/2025 12:35:58   Post Charge Certificate Correspondence
15/05/2025 10:00:47   Charge Certificate Issued
10/04/2025 10:27:09   PCN Issued

And the parking ticket shows the below

Parking ticket viewer
If you’re using a smartphone, click the menu button at the top of the screen to see more options.

PCN reference   MT00907537
PCN Status   PCN/NTO Sent
Vehicle Registration   GK16CJU
Contravention Date and Time   21/03/2025 15:35:43
Street   SS - EFFRA ROAD JW ASHLEY ROAD
Zone   LW0997
Contravention Code   53J
Contravention Description   Failing To Comply With A Restriction On Vehicles Entering A Pedestrian Zone
Contravention Charge   £65.00

So it appears it has been reset no need to go through the PE3 process.

Somone may know about this location and if there is anything to go on but at least you can now see it off for £65.
