52m on Pitfield Street, Hackney

Hi, just received this pcn from hackney for failing to comply with prohibition on certain types of vehicle.

Did not notice the very confusing red circle with car/motorbike symbols.  Also there are cars parked on that road so don't understand how some cars are allowed there but not others.

I looked at the photo/video on their site. As you can see on the pcn, one photo is completely black apart from a vague semblance of the number plate.  The cctv footage shows the car but is so fuzzy on the video that the number plate is not even discernible.

Is this worth disputing ?  What grounds could I contest it on?

The "Flying Motorbike" sign is in use all over London now, and the sign itself has been in the book of signs for councils to use for decades, but with the roll-out of Low Traffic Zones, it is now used a lot more. It means "No Entry for motorvehicles"

Dear Hackney Council,

I am writing in response to PCN reference [insert reference], which cites contravention code 52M: "Failing to comply with a prohibition on certain types of vehicle (motor vehicles)." I conditionally agree to payment if you can supply  further clarification and supporting evidence to confirm my liability.

1. Prohibited Vehicles: Please specify which types of vehicles are prohibited under this restriction and which are permitted. Provide the relevant legislation that supports this prohibition.

2. Nature of the Contravention: Is this considered a contravention, offence, or crime? Clarifying the legal basis is essential.

3. Evidence: Can it be verified that the footage or images have not been tampered with, or that fake plates were not used? Additionally, confirm the calibration and accuracy of the cameras involved.

4. Witnesses and Crime Report: Please provide the names of any witnesses and the official crime report related to this alleged contravention. Was any victim identified? Has there been any harm, loss or damage?

5. Legal Justification: The Bill of Rights 1689 clearly states that forfeitures of fines before conviction are null and void. I require confirmation that the enforcement of this fine aligns with both my human rights as protected under the Bill of Rights and the Universal Declaration of Human Rights. Please clarify whether a court conviction is required in this instance.

6. Liability Order: Kindly provide a copy of the liability order, signed by a judge, as well as any supporting legislation that allows Hackney Council to enforce this fine.

I look forward to your prompt response with the requested information.

Best to pay the discount and move on.

Oh sorry I realise now that the highlighter on the PCN may make it unreadable.. this is the contravention..
