Parkingeye HM Courts and Tribunals letter

Hi guys,

4 years ago I received a notice to keeper for parking in my university car park. My defence was that I had proof through my bank statement and the ticket that was printed by the machine (I still have these in case anything further arose), the only problem was that this ticket had only printed the back half of my registration plate. I have parked in this car park many times and this is the only time I had encountered this error and I would not have just inputted the last four digits of my reg plate. I obviously appealed this but unsuccessfully.

I had just been sent many letters over the past 4 years, but have received a letter from HM Courts and Tribunals Service.

I am looking for advice on where to go from here and whether I have a case with this.

I can't see a date on the claim form, so only you know that you have
14+5 days from its date to submit an Acknowledgment of Service or a defence
28+5 days from its date to submit a defence having previously submitted an AoS in time

The date was 8th September, so I have until 27th September.

A defence needs to address the issues and claims made in the original Notice to Keeper and the Particulars of Claim on the claim form. It sounds like you have the basis of a defence already - you paid, you have evidence of payment, their machines were faulty.

If you search the forum you will find that the majority of cases brought by Parking Eye and using DCB Legal are discontinued by the claimant before the court fee needs to be paid. So if you file a defence (simple, stick to the facts) and stay on top of the process with advice here you will very likely find this goes away after several months.

You have a court claim because the claimant knows that many people ignore them or miss the deadlines they impose, and can claim a judgment in default against you. If you research the topic by searching the forum for many similar cases you will get an idea of what to expect.
