As it says apply for set aside it seems likely that you now have a default judgement against you.  If you don't pay with 30 days of the judgement date it will be recorded as a CCJ and affect your credit record for 6 years.  The other option is to apply to have it set aside - you have to pay for this (£344 I think) - but you also need to show that you have a potential defence.  It may be possible to get ParkingEye to agree to a mutual set aside which is much cheaper, maybe on the basis of time passed since original event / non response to you SAR - but don't hold your breath.

The parking cos are pretty sharp on this game once they issue a court claim and stand poised ready to push the default button as soon as they can if the defendant fails to respond!

I have paid the solicitors the full amount. They obtained the CCJ yesterday, does that mean it will affect my credit history if they obtained the CCJ yesterday or it would have been the case if I had not made the payment in 30 days?

You need to follow the link I gave in reply #15 above and ensure that your record gets deleted.

If you pay within one month

If you pay the full amount within one month, you can get the judgment removed from the register.

Write to the court to say you’ve paid. You’ll need to send proof of payment from the person or business you owed money to.

Thanks. Is there a way to make a complaint about the MCOL procedure? They cannot just give 14 days to reply and release a obtain a CCJ if someone has claim money against you. It may be the case the person is away or has not got the mail/ communication on time. Atleast, they should allow 28 days period.

I doubt it.
That’s the way it works.
If you don’t reply within 14 days, there are consequences.
You seem to have known about the deadline anyway. Then you went overseas without responding.

That the parking operator was never likely to take this to a physical Court hearing.

Their strategy revolves around people messing up the requirements of the court processes.

What has happened on this occasion is EXACTLY what they hoped would happen when they started the process.

As soon as you failed to meet the court requirements they apply for the default judgement.

I sugest that this is no longer an issue of private parking tickets, but one of receiving a default judgment for whatever reason, and I’m not sure how much additional advice can be given by contributors to this forum.

I agree. It's just trying to save any future members who might be in the similar situation. I did not know it is so easy to trap someone and allow CCJ for which a person can suffer for 6 years. I mean 14 days is very short period MCOL should atleast allow 28 days for a person to respond.
