Hello All,

I have recieved a PCN for using a route to certain vehicles while i was looking for on the road parking, i stepped into the lane not relaizing it was only bus/taxi lane.

The PCN was issued on the 9 may 2024 and contravention date was 13-04-2024
When i calculate the days its coming to be 28 days on the 10 and 11 to be 29 days can i dispute the PCN based on that.

Regards,
Bob

(1)Subject to the provisions of this section, no penalty charge notice may be served under this Act after the expiry of the period of 28 days beginning with the date on which the alleged contravention or failure to comply occurred.

Contravention 13/04/2024
PCN Date 09/05/2024
Presumed Service 13/05/2024

32 days.

Unless it's a hired vehicle that's your appeal--- OOT.

Of course don't be surprised if the council rejects, some council officers are too thick to understand the difference between the date of the notice and the date of service of the notice. If the representation is rejected you should pursue a costs order against the council.

The rejection is drivel because the PCN was not served on the day it was issued, you should obviously appeal as the council's case is hopeless.

I'll drop you a PM in case you'd like to be represented.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
