Abandoned Sorn car in unenforced Residence parking bays

Hi folks,

There is one con artist who has recently bought a new car but dumped his old car in the parking space of blocks of flats. The parking bays there aren't enforced due to a vanished management company. So, he used this opportunity, and had dumped his car there by making it Sorn which is a giant nuisance for other residents. The irony is that the above immoralist person live in one of the flat there, and has been grassed up to local council but no action has been taken yet. But council cursory assessment says that he is not breaking any rule when actually he is by dumping his car in shared car parking bays. As per Sorn policy it should only be parked on private land. So what should be the best course of action should be?

But, from your description, it is indeed parked on private land.

It seems that any rule he is breaking is internal to your blocks of flats, and nothing to do with the council

What does the lease say about the parking area for the flats? Does it state that vehicles must be roadworthy and taxed? Does it state the number of vehicles that can be parked per flat? If it's within the terms of the lease, there's nothing you can do about it. (I lived in a flat once, where one of the leaseholders had a wreck of a car in his allotted space. People moaned, but I pointed out that it was in his space and didn't breach the lease in any way, so put up with it.)

If there is a breach, then you could try getting the freeholder/landlord to do something about it. Good luck with that if it isn't actually impacting them in any way.

99% flats are on rent so renters don't care the contents of any lease. The said parking area has got around 12 parking bays which are not allocated to anyone. These were previously self managing by the flat residents on first come first serve basis. The previously mentioned blatant disregard has now emboldening others too to do same and more sorn cars are now springing up. One scumbag has now covered his car with plastic covering to hide the car Identity. Since the management no longer exist so why not use this opportunity by yourself as well by emulating this practice.

Covering the number plate is an offence, whether or not it is on the road [Vehicle Excise and Registration Act 1994, s.42(1)].

You could report the miscreant to the police (with no guarantee they'd take action).

But we certainly cannot encourage you to break the law.

Whilst it may be sorned, the council (and environmental depts) may be interested if it is VERY unroadworthy.

We had a car sorned in my old flat car park, flat tyres, moss growing on windows/doors, food inside dated 3 years previous. The council came and placed a notice on it that it was going to be removed, followed by a scrappy sticking a business card on it, then it disappeared, presumed taken by the council (or a scrappy).

So it can be done, but will probably depend if it is just sorned and roadworthy, or sorned and a danger to the environment.
