So back in may I got caught speeding on the motorway, which I paid the fine for, and sent my info by post as requested and didn’t hear anything until now.

I’ve now received a notice to say I failed to provide information relating to the identification of the driver / rider of a vehicle when required.

And it also is now saying I was speeding, which is the offence of already paid the fine for. But says they’ve requested to pay refund the fine I’ve already paid as they want to take me to court for both.

What can I do here? I’ve paid the fine and sent my licence etc. off as requested at the time, but looks like they’ve not received it or chased me again to make me aware they haven’t received it.

Obviously I don’t want anymore points or a big fine over this so is there anything I can do to help this ?

Or do I have to now plead guilty to all for the sake of it when I’m only guilty for the speeding?

I assume you responded to the s172 "Request for Driver's Details" which you received along with your original Notice of Intended Prosecution? And after that you got a "Conditional Offer of a Fixed Penalty" which you accepted by paying the fine and submitting your driving licence details?

If so, you are in quite a strong position. You must have responded to the s172 request for the police to have made you an offer. So you can plead not guilty to that and provide evidence that you responded by showing a copy of your fixed penalty offer. Since the police are saying that you did not respond to the s172 request they can have no evidence that you were speeding, that that charge should fail as well.

It would help if you could tell us exactly what you received and when together with details of how you responded and when.

If the OP paid a fixed penalty and has been charged with failing to provide information contrary to s. 172, either he received an Avon & Somerset "Super NIP" or something has gone spectacularly wrong.
