What will happen to me? SJPN
« on: October 04, 2024, 11:04:49 pm »
Hi all, firstly thanks in advance for any advice. Very nervous about whats going to happen in this situation.

Order of events below.

1. Recieved NIP for speeding 50MPH in a 30MPH. Checked the camera footage and shows 49 MPH on the still image.

I admitted I am the driver, which I was.

2. Recieved a letter telling me the speed is too high for a course or FPN and awaiting a Single Justice Procedural Notice.

My question is, what is the worst that can happen in your experiences here?

I have a 100% clean driving record for 13+ years. I was speeding as i thought a family member was having a genuine medical emergency, no excuse I know and fully out of character for me as im a careful driver. Will never happen again.

Any advice would be great. I need my licence and cannot do without it.

Thanks in advance.

50 in a 30 limit would normally qualify for a fixed penalty. But, for whatever reason, that ship seems to have sailed.

The magistrates' guidelines for that speed:

- Fine of a week's net wages, less a third discount for a gulty plea
- Victim surcharge of 40% of the fine
- Prosecution costs of c.£90
- 4 to 6 points on your licence

Other than unsubstantiated claims that somebody had heard of some areas offering fixed penalties for up to 55 in a 30, 49 has always been the highest speed for a fixed penalty in a 30 limit.

Band B covers speeds of 41-50 in a 30 limit, so absent any compelling mitigation, will be looking at anywhere between 6 points and 6 points.

Thanks for the replies.

The camera footage shows 49MPH but the letter says 50MPH. Is this something I should include in my side letter, also mentioning a clean driving record or not worth bothering?

Im guessing 6 points plus fine it is?

The speed shown in the image is irrelevant, and likely isn't even the "money shot". It will just be a picture to aid in identification of the driver

The evidence submitted with the SJPN itself may be relevant. The fact that you have seen  a still showing a speed of 49 is mostly not.

Believing that a family member was having a genuine medical emergency is not in itself relevant. If you were driving them to hospital, or going to see them before they potentially died might be. The fact that you merely thought they were suggests that this will be difficult to substantiate.
