Author Topic: Speeding Exceeding 30mph and Section 172 Failing To Provide Drivers Details Where do I stand?  (Read 89 times)

I received a NIP late last year about a speeding offence. A little background on the whole situation.

I own a run a limited company with my business partner which is split 50/50 equally. We have a work vehicle which is used soley for company purposes. Upon the time of pruchase I registered the vehicle in my name, mainly for lack of knowing it was even possible to registered the vehicle in the companies name.

Nevertheless, the vehicle has remained in my name, never been an issue. However upon receiving this NIP for speeding it was clear it was my business partner driving at the time. He has agreed to this, and we filled out the paperwork together and it was sent via post.

A month of so later a SJPN was sent to me, for the speeding offence above and a further offence of failing to provide the drivers details. I am shocked there is no form of reminder, or a follow up letter before a court summons.

What is my best course of action? I believe it is fair to plead not guilty to both offences. However I've neevr been to court before and from what I hear form a lot of people theyre just going to sting me regardless.

Further relevant info - offence was in the west midlands, I already have point on my lisence so would prefer not to havew anymore. The driver at the time was insured and is willing to be a witness in court and attest to the fact that he was indeed the driver and that he witnessed me posting the paperwork.

No that should be 3/12/25, bit of a typo there.

The response was posted on 14/11/25 I remember it was the Friday before I went to the safari park with the kids.

The usual advice is to plead not guilty to both charges and then offer to plead guilty to speeding provided the “Fail to Provide” (FtP) charge is dropped.

Unfortunately you cannot do that as you were not driving. The speeding charge is therefore a dead duck as the police have no evidence to prove who was driving.

The only option you have, apart from pleading guilty to the FtP charge, is to defend it on the basis that you did respond.

I know you’ve provided some dates but your timeline is still a little puzzling. Could you provide a timeline of events.

Specifically:

Date of alleged speeding offence
Date of NIP (and request for driver’s details)
Date you received it.
Date you responded to it
Date of SJPN
Date you received it

I assume you do realise you had only 21 days to respond to the SJPN?

SJPN likely to have been served 2-3 weeks after charge date - so 1 -2 weeks ago. I was also confused by the OP's claim that the SJPN was received "a month or so" after sending the response.

So, xpistos, the speeding charge is now irrelevant and will be discontinued.

I believe your choices are to either plead guilty to the FtP charge or plead not guilty and defend it on the basis that you did respond.

If you unsuccessfully defend the charge, the offence carries a fine of 1.5 weeks’ net income, a surcharge of 40% of that fine and you will pay around £650 towards prosecution costs.

If you plead guilty, the fine and surcharge will be reduced by a third and the costs will be in the order of £100.

In either event you will also have six points imposed on your driving record and an endorsement code (MS90) which will see your insurance premiums increased considerably.

Of course, if you are acquitted following a trial, you walk away with your wallet and licence unaffected.
