NIP received after 14 days
« on: »
Good morning,

The registered keeper of the car (my partner) received a NIP dated 19 October for an alleged offence on 26 September. I was the driver so they provided my details within the 28 day period. I have received a NIP and responded to confirm my details and that I was the driver. All within timescales. As the NIP was originally dated 19 September and this is over the 14 days can I ask for my case to be dealt with in the Magistrates' Court? Do I have a case?

Many thanks

Kelly

Are you 100% certain that your partner is the RK, have you seen the V5C document in their name. Is the vehicle leased perhaps?

Regardless of the facts, or even if the "facts" are fiction, you can ask for the case to be dealt with in the Magistrates' Court, although that "option" is mostly psychological marketing - there is no need to actively request that the case be dealt with in the Magistrates' Court, if you are offered an out of court disposal, such as a COFP, and you do not accept it, it is then up to the police to instigate court proceedings.

To clarify, you are telling us that your partner is the RK of the vehicle in question, and that the alleged offence was on 26/09/2025 and that his NIP was variously dated 19/10/2025 (24 days after the date of offence) and 19/09/2025 (7 days before the date of offence).

You have also avoided telling us the nature of the alleged offence, or anything else that might indicate whether a NIP would be required.

The magic 8 ball says "Outlook not so good"

We are reliably informed that for an initial NIP to be issued outwith the 14 days requires a manual over-ride. We have been unreliably informed that in this case your partner is the RK.

Apologies, for the typo on the second date saying 19th September as this would rightly be before the event. The offence was travelling 35 in a 30 zone and it was a camera attached to the traffic lights as previously this was a traffic light camera only but the road has changed from 40 to 30 in recent times. I will check the V5C as the interesting point that the NIP would have to have a manual over-ride to go out over 14 days.

To clarify:
The registered keeper of the car (my partner) received a NIP dated 19 October for an alleged offence on 26 September. The offence was for speeding - exceed 30 mph on restricted road in England - automatic camera device; Speed 35 mph. I was the driver so they provided my details within the 28 day period. I have received a NIP and responded to confirm my details and that I was the driver, within 28 days. All within timescales. As the NIP was originally dated 19 October and this is over the 14 days can I ask for my case to be dealt with in the Magistrates' Court? Do I have a case?

As with the above, I shall check the V5C and look to see if it is leased.

You may not even have the V5C...

Also check that the address on the V5C is correct and current, and was so at the time of the offence (that the date after the DocRef. No. at the bottom of page 2 of the V5C is before the date of offence).

If he doesn't have the V5C in his possession with his correct and current details, to all intents and purposes he is not the RK.

No need to reply to this post until you either have the V5C in your hand or have accepted that he is not RK.

Thanks all,

I have verified that this is a lease car through work so not the RK. We have checked with the paperwork we have. It didn't occur to him that he was not the RK!

This has been helpful.

Thanks
