NIP has wrong location
« on: »
Hi, on the 31st of July 2025 I allegedly was caught speeding 25 in a 20 mph zone on the NIP the address is Baker Street London NW1 however as I drive a taxi I was on a Taxi app job of which I have proof I was in Victoria SW1

I have submitted evidence myself. My vehicle was on a taxi job 4 miles away. They have to respond by the 21st of August
I am still within the 28 days to return the NIP

We have passed the 14 days for them to send an amended NIP

What will happen now?

Will they cancel it because of the error on the NIP or will they be pushing to go to court?

Any help appreciated

Thank you

I hope I’ve posted this in the right place

Let us know - I don't think anyone here can tell you what their next move is.  Depends on the facts they believe.

I would be concerned about a cloned plate rather than their 'error'?

Have you seen any pictures?  If they believe a cloning then they may ask for you to to supply photos of your own.

They have to respond by the 21st of August
Not sure I get what this means?

Not cloned plates, the pics I can see my pink shirt but not me.
There is a video but there not letting me see it.

The 21st is the ( within 10 working days to reply ) date of the evidence submitted.

I believe they haven’t changed the location on the camera prior to setting up somewhere else

Who has got to reply within 10 days? And for what purpose? What happens if they don't reply?

I'm asking all this because I'm puzzled. I've never heard of anybody having to reply within 10 working days to anything and I'm not sure where this fits into your problem.

If you challenge before sending the NIP back they ,the police  will get back to you within 10 working days, before you have to send the NIP back within is 28 days

I challenged the NIP based on I was not where they said but 4 miles away

It seems you've raised a query about the allegation rather than challenge it. There is no right of challenge to a NIP or a s172 request for driver's details. At this stage the police do not even know who was driving. I think you have been somewhat optimistic.

You have an obligation to respond to the request regardless of any issues you may have with either the NIP or the offence itself.

You can raise a query on the portal

My query is I wasn’t where they said

I still have until 30/08/2025 to return the paper who was driving.

I don’t want to return to early because it states I was driving on that occasion which I believe will incriminate me

Note that the 'query portal' says they aim to respond within 10 working days .

Personally, I’d be trying the phone number for a more interactive discussion.

There may be a disparity between timestamps.  Whether you were at the claimed locus or not would be critical to your response.

You seem to have the wrong idea about this.

You cannot challenge a NIP. It is simply a notice informing you that a prosecution is being considered.

What is of greater importance to you is the accompanying “request for driver’s details”. Unless the police formally tell you that action against you has been discontinued, you must respond to this. If you fail to do so you commit an offence which, on conviction, carries a hefty fine and six points. Any details of the speeding allegation, including the possible error with the location, then become irrelevant.

The police might respond to you before you are due to reply to the request or they might not. As above, they only aim to respond within ten days. They have no obligation to do so – in fact they have no obligation to respond at all.

In my view, what you need to do is to respond to the request by saying that your vehicle was not at the location mentioned at the time specified so you cannot provide them with the details they require. Do his either on the form provided (if there is an appropriate section) or by means of an attached letter.

There is no point in delaying this. If the police do respond to your query in time they will either say the matter has been discontinued or they will still require a formal response to their request. If they don’t reply in time you will have to respond anyway.

New judge

I still have until end of this month to reply

I will reply with attached letter within 28 days if I don’t hear from them

Trouble is I already filled out part of the back of the letter

Contrary to popular belief, you don't have to use their form.  (But the response is part of a legal process)

Yes I know. I'm simply trying to explain that you might as well do so now. At the end of the month your response will be identical. Still, your choice.

OP has been given advise elsewhere that they should allow 14 days to elapse so there isn't time for the police to send an amended NIP with the correct location.
