Company Car - NIP not received
« on: »
Hi all
I wonder if you can offer some advice please
My company informed me that my lease company had received a NIP for my company car 5 months ago
The lease company tell me that they replied to the NIP providing my name and address
5 months later though I have not received the NIP from the police. I've double checked with the lease company and they are adamant that they have provided the correct address
I have read some articles where people have received 6 points for not replying to a NIP even though it was sent to the wrong address
The lease company advised me to just wait

Is it my responsibility to contact the police to see where it is?
Or can it take several months for them to issue the NIP to the named driver?

Thanks for any advice at all

There's a bloke works down the chip shop swears he's Elvis.

I would variously question the veracity of these "articles" you've allegedly been reading, or the veracity of your reporting of them.
I am responsible for the accuracy of the information I post, not your ability to comprehend it.

There is no legal responsibility but I get the curiosity.

Usually weeks, not months.  Given they have 6 months to prosecute the underlying offence it would be monumentally stupid for them to wait so long (but it does happen).

Arguably there's nothing to be lost in trying to contact them (Although there's an extremely slim chance they do have time to get a s172 to you and prosecute depending on the exact dates).  But as you don't have any paperwork that may be a challenge - although Googling the local safety camera unit may produce something.

There's little point commenting further without knowing the hand you've been dealt.

I'd wait until the 6 months are up from offence date before contacting the camera unit.
Purely speculative but two options may have happened & someone somewhere will likely be prosecuted for an FTP charge as the process seems to have started.
1) Lease Co. reply nominating you was never received back to the camera unit - Lease Co. are then on the hook for the offence - they may not even know it.
2) Your own S.172 never reached you for whatever admin or logistical reasons. You will then have a possible defence but will need to attend court to ask to be sentenced for the original underlying offence rather than the more serious 6 points for FTP.

Or perhaps defend the FtP charge on the basis that the request was never received - especially if the lease company gave an incorrect address.

Of course - yes - very true NJ - that would be the best option too if all the paperwork shows the lease co. is at fault & no need to even plead to the underlying offence.
