46mph on M1 on 1st 40mph Gantry

Hi all
I just received my first notice of intended prosecution of speeding for around 15 years.  I was on the M1 between J15 and J14 at 2:47am last week when the overheads started flashing 60 so I slowed to 60 with no reasons given.  Then it went down to 50 so I complied.  Then it showed the 1st two lanes were closed ahead so I started pulling across ready still doing 50mph.  I had trucks up my arse but I wasn't taking any notice of them. Then as I approached the two closed lanes, the gantry overhead showed 40 (for the first time) and I started slowing to 40 from my steady 50 and the same gantry flashed me.  I had trucks tailgating me (which then pulled out and at least 10 overtook me during the lane closures). 

Today I received the notice of intended prosecution for doing 46mph.  The very first gantry at the start of the 2 lane closure and the very first gantry showing a reduction from 50 to 40.  Surely I can fight this as I was slowing at short notice and I was doing 46? 

Any help would be hugely appreciated as I feel this is very unjustified.  It's Northamptonshire Police.

So I just have to accept this?  I'll be fighting it as it's pathetic.

How do you plan to fight it?

At this stage, all you can do is respond naming the driver. You should then be offered a speed awareness course (c£90) or a fixed penalty (£100and 3 points).

The only way to fight it is to ignore or reject those offers, and plead not guilty when it eventually reaches the court stage.

The police will undoubtably produce photos showing you passing the gantry at the alleged speed. How will you cast reasonable doubt on that evidence?

Bear in mind that the cost of the likely failure will be nearer £1,000 than £100. Plus a day of your time, win or lose.

Ok, please don't jump on me.  I'm only asking as I remember the old Pepipoo days and things have clearly changed.  Its been years!

I understand this letter is just asking me to admit I was the driver and I was and I have submitted that.  I will not be at all happy if they whack points on my clean licence and I will be asking questions if that happens. I'm happy to take the course if offered despite my opinion on its fairness.

All I am saying is I find it extremely harsh.

What a friendly community.  Can't you understand I am annoyed for OBEYING the limits and the gantry gave me zero chance to slow down in time?  I am not blaming anyone here!

I didn't think I'd jumped!

Anyway, you will almost certainly get the option of a course, and be able to do it online.

Some regulars on here tend to disparage these courses, but I don't. I did one recently, and didn't feel judged or patronised. OK, I didn't learn anything, but then I've worked in road safety and also lurked on these forums for yonks. I believe the average "civilian" would have found it useful.
