Hi all,

Please see below driver's first ever NIP. Was not actually trying to speed, was just under the assumption it is a 40 road which obviously isn't going to be an acceptable reason.

Is there any argument to challenge the speed limit if so many people are caught out and there is no benefit to road safety? (Seen a lot of cases online for this tunnel) so this restriction must be setup to catch motorists and generate revenue.

Lastly, what is stopping someone from saying the letter arrived after 14 days? A lot of the recipients' post is delivered to the wrong address with a similar door number.

Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - The driver was approaching the tunnel from the Canary Wharf side where the speed limit was 40 and assumed that limit continued as the road layout does not appear to be a 30 road. Driver was doing 35 in the Speedo but NIP states 36. There are signs before entering the tunnel which can be viewed on Google but these were not observed whilst driving. Additionally, the camera was not noticed as it is not yellow.

There's no ground for challenging the limit - they're typically before a limit is set/changed although not necessary. There's been many convictions along there so the road is correctly limited, signed etc etc....unless someone has messed with the signs/streetlights recently??!!

In court you would be asked to prove delivery after 14 days - unless you have a genuine witness who can attest to this - which you clearly haven't - don't even think about it! £100 and 3 points or a dull course only, so unless you're on 9 points, it's a risk doomed to fail....and jail!

Hopefully you asked this purely hypothetically, but to answer it, the risk of a prosecution for attempting to Pervert the course of justice, which typically carries a jail term of 6-9 months(and the serious implications such a conviction brings in other respects).

More pragmatically, without any supporting evidence it's unlikely to be accepted anyway.

There is an obvious flaw in your thinking that because many get caught the limit is wrong, hopefully with some thought you can see the error.  Not least the only way a road can look like a 40 limit road is if it has 40mph speed limit signs, and this doesn't (all in the Highway Code).
